Arbitrary deduction from mobile prepaid account

Sub: Complaint No. GBL98114990 dated 15.02.2011 and Complaint No. GBL 098196408 dated 19.02.2011.

I have made the subject two complaints against the arbitrary deduction of Rs.45/- (Rs.30 Rs.15) on 15.02.2011 by the Tata Docomo from my prepaid Mobile No.8087905303. At about 7 am on 15.02.2011 I have received two service SMSs from the Tata Docomo about the deduction of Rs.45/- from the prepaid account, stating following reasons:

(a) Rs.30/- for data usage on 15.02.2011

(b) Rs.15/- for data usage on 15.02.2011

Since I have not made any request for data usage or for loading of caller tunes on that day or any time prior to that, I immediately lodged complaint No. GBL98114990 with your Customer Care against these arbitrary deductions on 15th February itself, and I was promised refund against the above deductions within 24 hours.

Since no refund was forthcoming, I made follow up calls on 16th February and also on 18th February and both on these occasions, I was told that my complaint is still on and the refund will be made within 24 hours. But on 19th February on making another follow up call, I was astonished to hear from Call Centre Executive that my above complaint has been closed without any intimation to me about the outcome of the complaint.

This is not the first incident of your arbitrary deduction from my prepaid mobile connection. Earlier too, a similar complaint was made and after a prolonged follow up of about 40 days, I was given the refund. Now, after a period of about 6 months or so, I was again put to the same task of seeking refund against another arbitrary deduction by you from my prepaid account.

May I now request you to please look into my complaint and arrange to refund of Rs.45/- to my prepaid account against the arbitrary deduction as I have not made any data usage or requested to loading of caller tunes on 15.02.2011 or any day prior to that.

If no refund is given I shall be constrained to approach appropriate forum, which may please be noted.
