There was an offer of Buy 1 Get 1 free from Mega Mart, Kanakapura Road, Bangalore. I purchased Wrangler Jeans on 29-Mar-09
under this offer. At the time of buying they mentioned out of these 2 Jeans whichever has highest MRP we will be charging
you that as per that 1 Jeans had the MRP of Rs.1495/- and the other had the MRP of Rs.1395/-. After a week i realised that
the Jeans with MRP 1495/- had some defect and on 10-Apr i went to the shop and complained about the defect and asked for
replacement. They said at present they do not have the model / color i wanted and the person incharge (Mr. Prakash) mentioned
that he will try to get that within 15 days. On 25-Apr i received a call from him and he said he could not get the model /
color combination of Jeans and i have to select some other color / model combination.
So again I went to their shop and tried different model / color Jeans and finally selected a Jeans which had the MRP of
Rs.1395/-. But when i asked for the balance amount of Rs.100/- they mentioned he can not pay that amount as it is against
their policy and said if you want the same color / model / price combination jeans then you need to wait for some more time.
Also when I asked him for the tag on the new Jeans pant he refuesed to give me that.
I feel it is clear cheating of charging more than the MRP. These big brands always cheat people by selling some defect
items. It is not about getting Rs.100/- from them, it is about knowingly fooled by somebody.
With this issue can i go to consumer court and drag Mega Mart to court and teach a lesson to them? If so how to approach consumer court.
