I had a query on the matter of the Society transfer donations which is collected by our society.
We have a flat in the apartment build by private builders on the Mhada land.
By virtue of the same we had to pay the Mhada transfer fees to the Mhada office on purchase of the flat.
We had purchased our Flat in year 2001 directly from the builder (First party).
We had paid to Builder a sum of around 34K as society charges apart from the cost of Flat, registration charges and other charges (as a package deal) while we had purchased the flat.
Also as per the package deal builder was suppose to pay the Mhada Transfer, but he failed to do so.
The Society got it's OC in year 2003 and the Society was formed and we were the registered member of the same. (Till then the society was managed by the Builder).
After that year if there was a sale of the flat any of the flats society used to collect Rs 25K for the transfer of the flat.
This year after the finalization with the Builder that he will not pay the Mhada transfer as same was not documented any where, we decided to pay the same and approached our society for the NOC to the same. But our society Managing committee is refusing to provide the NOC saying the we will have to pay the society transfer donation without which we will not provide the NOC.
We showed the receipt to the committee members that we have already paid a sum of 34K to builder as society charges and also that we a registered member of he society since the society was registered still they refuse to provide the NOC.
Please guide us what can be done in the following situation and what is our legal stand in this situation.
