Moto w388 not functioning within 15 days from purchase

Cannot be repaired

I bought one motorola MOTO388 on 23.11.08 for my wife It started problem within 15 days. So I contacted the retailer The mobile store, VIRAR .he advised me to contact authorised service center.then I deposited the handset on 15.12.08.but till today it cannot be repaired.whenever I contact the service center they tell to contact after 2 days Now it is more than 2 week time since I deposited the handset at the service center. If it cannot be repaired.they must provide me replacement handset so please help me if you can.
