TO WHOM IT MAY CONCERN
Respected Sir,
I Suman Chatterjee, S/O Sri Sukamal Chatterjee, residing at Indrapuri Abasan, 46 Raj Rajeswari Road, 3rd Floor, Flat No-14, P.S- Dum Dum, P.O- Ghughudanga, Dum Dum. Kolkata- 700030; would like to state the following situation and intimidation, me and my family are being subjected to:-
1) My wife (Mrs. Arani Chatterjee) and I, entered into an agreement of booking a flat, situated in a new proposed residential building named ‘Ankit Plaza’, with all common amenities, facilities lying situated at 181/1J Dum Dum Road. Kolkata- 700074. P.S- Dum Dum, with one Mr. Hiralal Malakar, S/O Lt. Ananta Malakar, proprietor of M/S Omega Property Developers, at 55/9 Purbo Sinthee Road, Kolkata- 700030. P.S- Dum Dum on dated 16/12 through Mr. Swapan Malakar, S/O Mr. Hiralal Malakar.
2) It was agreed upon between us and documented via Agreement / Memo that, I along with my wife will pay Rs. 35, 000/- (Thirty Five Thousand) only, towards the flat booking and the Agreement /Memo will be valid up to 15 Days from the date of execution, which was 16/12 and if the proposed buyer did not book the flat, the agreement will be cancelled and the ‘Developer’ shall return the deposit of Rs.35, 000/- (Thirty Five Thousand) only to the ‘Proposed Buyer’.
3) After a fort night, when the said flat booking agreement was not made available to us, we ask the ‘Developer’, Mr. Hiralal Malakar, Proprietor of ‘Omega Property Developers’, to return back the said Rs.35, 000/- and upon repeated persuasion Mr. Swapan Malakar, S/O Hiralal Malakar, who is to look after the day to day business transaction of the Omega Property Developers, issued a cheque of Rs.35, 000/- from his own account.
4) The said cheque when deposited into my bank account bounced, due to ‘Insufficient Fund’ and returned back to me.
5) When we informed Swapan Malakar and Hiralal Malakar about bouncing of the said cheque, they assured me of payment and asked us to return the cheque, but as I refused to return the cheque to them, until the payment is made, they started threatening me and my wife with dire consequences.
6) Till today Hiralal Malakar and Swapan Malakar did not refund the booking money of Rs.35000/-, we feel cheated, in secured and vulnerable, we feel we were cheated and the developers had no intention of selling any property to me and my wife.
7) Being subjected to abuse and harassment in claiming our hard earned money we lodged a complain at Dum Dum Police Station at dated 08/04 against ‘Mr. Hiralal Malakar & Mr. Swapan Malakar’. However, till today neither did we get back our money nor the P.S. took any legal action against them. The present scenario is even dire as the Developers are now taking advantage of the situation and inaction by the Police and continue to threat and harass us for the steps taken against them.
8) The Malakar’s have not only violated the ‘India Govt. Stamp Paper Agreement’ but also showing-off their ‘Political Influence’ by giving us life threats.
9) My wife and I live alone in the same locality with our children; and we are very scared for our life and normal existence in the locality.
It is our earnest request to you to kindly intervene and ensure justice is bestowed before it is too late. You are our last resort; we do not have resources to stand up against the Developers and we also stand to loose our money and may be more.
