Efusal of refund

I invested in a 3 br Residential flat for self use of 1500 sft at the rate of rs 1325.00 in M/S TRIVENI INFRASTRUCTURE DEVELOPMENT COMPANY LTD:

Advance paid rs 300000.00 Vide receipt no: 8800000206 dated 15/03/06

1st int. paid rs 300000.00 Vide receipt no: 8800005569 dated 08/11/06

I have chosen sect 89 as my choice of allotment.

Since even after 3 years the construction on site is minimal and Triveni has not allotted me a flat in this sector I request that my deposit may kindly be refunded.

I have approached the company but they refuse to refund the entire amount.

i am neing forced to transfer my booking into IT which is not even an approved project yet.

alternatively they are implying that i take the booking at a now escalated price of 2100.00 rs per sft.which is beyond my affordability and illegal since my boking is for 1325.00 rs per sft.

The builder is not taking responsibility for the delay in the project.

as per booking conditions I am entitled to 10% interest p.a.

This makes the total amount to be rs 798600.00

I request that this amount be paid to me at the earliest.
