Sir,
Under instructions from and on behalf of my client Mrs. Neelam Singla, Resident of House No. 2360/2, Mariwala Town, Manimajra, Chandigarh I, Krishan Singla, Advocate do hereby serve you with the following legal Notice:-
1) That my client is a student of PH.D. (PHYSICS).
2) That my client wants to search new topics on Internet, which helps her in preparing her P.hd topic.
3) That influence by your advertisements, pamphlets and brouchers my client decided to install your reliance broadband with landline phone.
4) That my client called your representative named Sh. Suraj Pal who paid a personal visit to my client’s residence and he
Introduced my client to your different broadband packages and landline phone schemes.
5) That influenced by your representative’s words my client decided to have a broadband connection with your landline phone facility. For the decided package your representative told my client that she would have to pay Rs. 500/- at spot.
6) That my client without hesitating and in good faith paid a sum of Rs. 500/- at spot and your representative issued a receipt to this effect.
7) That your representative assured my client that the connection will be installed/activated within a 48 hours from the date on receipt.
8) That my client waited for one than 3 days but when no body turns up from your side. My client made a phone call to the person who has issued a receipt on your behalf. The person named Mr. Suraj Pal told my client that it was better to talk with Mr. Arum who is the controlling authority.
9) That my client made a phone call. Mr. Arun assured my client that the connection will be installed in the next week. My client waited for another week but again the promises from Mr. Arun was totally proved a just excuse.
10) That thereafter my client made several phone calls but every time your representative either befooled my client with lame excuses or took his phone on busy mode intentionally.
11) That you have no right to retain a hard earned money of my client without serving any kind of services.
12) That you have cheated my client and misappropriated her hard earned money.
13) That by this illegal and unconscionable and malafide action/design, you have rendered yourself liable to be prosecuted for criminal offences u/s 420, 406 IPC committed by you under the various laws and an additional remedy to approach before the consumer courts.
I, Krishan Singla, Advocate, therefore by means of this legal notice call upon you to install/activate the broadband connection with landline phone with immediate effect or in alternative refund the activation charges paid by my client which comes to Rs. 500/- with a sum of Rs. 5, 000/- to compensate my client for the mental agony and physical harassment. A sum of Rs 11, 00/- be paid as a cost of the present legal notice. The entire payment should be made in the favour of my client with in 24 hours from the date of receipt of the prsent notice failing which my client shall be constrained to take necessary action, as advised, against you in the competent courts of law, and in that event you shall be held liable for all costs and consequences of such proceedings.
Note : 1.Only written communication vide Registered Post would be entertained.
2.I retain copy of the present legal notice in my office for further necessary action.
