Issue with Nokia 5800 Mobile phone

Dear Sir,

I had purchased a Nokia 5800 phone in Jan as part of a pre-order.

Since then, then phone has given me various software issues related to firmware. The company has on timely basis released firmware updates to solve some of the issues. However, the firmwares just kept on creating more issues than it could close.

I am currently stuck with a firmware version which makes the Internet connection (Wi-Fi and EDGE), FM radio and Acceleratometer work erroneously.

These features stop working suddenly for no reason. Sometimes a reboot makes the feature work, sometimes even that does not help. At times, switching off the bluetooth solves the problem and at times it doesnt.

This has led to a phone which I cannot rely on for using internet. I have spent INR 22000 on purchasing a phone so that I can have mobility and internet access on demand. With such erroneous behaviour, it defeats the purpose of mobility.

The problem has been acknowledged by the Nokia Care Centre (at Opera House) as a firmware issue. However, the company refuses to provide a timeframe when the correct firmware will be released. On demanding a replacement with a new phone, the technician is not willing to discuss and asks just to wait for the new firmware.

Please help me obtain a refund for this phone or at least provide a replacement phone which functions correctly.
