On 5th March, Using his website I had contacted the seller namely, Abhishek Avate, Director, on his cellphone number 996788444 and ordered the purchase of 2 pieces of Power savers by transferring full & final amount of Rs.2900/= in advance to Abhishek’s ICICI Bank account no. 040601501557, vide online transaction id number 000094710685 dated 05.03.2009.
On 7th March, the seller had sent me old defective/broken pieces of the power saver, that were returned to him on the same date after talking over his cell phone number 996788444. Abhishek asked me to return the product through DTDC, if I wanted the product to be replaced fast. As per Abhishek’s choice of courier, the junk pieces were returned through DTDC vide consignment note no. Z86256398 dated 07.03.2009. To my utter surprise, after this Abhishek Avate (the Seller) and also the manufacturer (M/s Aztech Electronics) stopped responding to my requests.
On 27th April I had sent Registerd-A/D notices to both these parties giving them a week’s time to respond, failing which I will approach competent court of law on their cost. But I have neither received my product nor any response from them.
The above-stated website not only claims their product to be of the best quality but also offers consumer a money back guarantee and a warranty of 1 year on defects. I find myself cheated by trusting whatever is mentioned on their websites. I am approaching you to please address my grievances in such a manner that no other consumer falls prey to such companies indulging in malpractices through catchy and false promises over their websites.
On 1st June, while I was in Mumbai, I called Abhishek Avate from PCO in Shere Punjab Colony, Andheri East, on his above given Mobile number, and gave him my address asking him to send me the product by 6pm as I had my flight back for Delhi at 7:45pm. Earlier he said he has not received back the product. Then I gave him the courier details. He still has not accepted that he received it. However, he started saying me that I am also an Assistant Police Inspector and I can arrest you there. I thought he was joking, but to my utter surprise, the person with same voice and face as that of Abhishek Avate crossed our way around 6:30pm, while I along with my family were moving for catching the Kingfisher flight number IT0037. He was with the PCO operator and threatened the cab driver to stop the car, then he from a distance started showing me his I-card, police helmet and non-bailable warrant. He said the owner of power saver firm is a close relative of a
police DCP who had lodged a complaint against me. On that basis a CR has been opened. He started abusing me in the crowd that gathered there and took out leather belt from his carry bag and said “You are arrested and I’ll have to take you to the D.B. Marg Police Station at Lamington Road. And on the way I will bit you with the belt all along.”. He created terror scene for about half an hour. There was one Sardarjee also present in the crowd who was reportedly a DCP in CBI. The API finally said that he will allow us to go only when I give him in writing that I have received the product. Since we had to catch our flight, one of my relative gave him in writing that the product has been received. He also demanded sending out confirmation SMS from my mobile that I have received the product. I had no option but to send out the SMS to his mobile. Though he was carrying the product with him, yet he walked away without giving us the product. However he
forcefully took the acknowledgement that the product was delivered. While going he threatened me of dire consequences, if I proceed any further with the complaint after reaching Delhi. He used abusive words without caring that a lady (my wife) was also there sitting next to me and said “ do not forget that the Cr case has already been registered by me against you which can be brought into action any time.”
I here by request you to please verify who is Abhishek Avate? Whether Abhishek avate was threatening using some police API’s I card, Police Motorbike and police helmet? or Abhishek Avate is really an API who is indulging into on-line trading under fake name and threatening an MNC executive like me? The people there heard him saying he is API Gaikwad from D.B. Marg Police Station, Lamington Road, Mumbai. Although immediately after this incident he had removed his photo from the website “mouthshut.com”, yet I have his photograph with me which can be presented on demand during investigation. Kindly carry out a thorough enquiry into this act of un-lawful trade practice through threatening, punish the culprits and please help me recover undelivered product and expenses incurred by me in the entire process.
