Subject Registration of First Information Report (FIR) regarding obtaining Building plan sanctioned with fraudulent documents and illegal construction by Shri Sourabh Malik s/o Late shri Surender Kumar Malik and Mrs. Veena Malik w/o Late Shri Surender Kumar Malik
Dear Sir,
I have been living with my family, in my house at C-29, Rajouri Garden new Delhi for more than 50 years as per the house plan sanctioned by MCD in the year 1962, constructed at front half-portion of the said plot. The rear-half portion was left vacant as a share for my Brother Shri Surender Kumar Malik and I have been paying ground rent property tax and other allied charges.
In the year 2010 Shrimati Veena malik, (Widow of my brother Shri Surender Kumar Malik) approached me with a request for partition and to take possession of the rear-half portion of the plot. As an honest, civilized and peace loving man I agreed and partition was duly registered and I handed over the possession of the vacant rear-half portion of the said plot. The construction started by my nephew Shri Saurabh Malik, one son of my brother Shri Surender Kumar Malik and Mrs. Veena Malik. When I asked for the copy of the Building plan he did not give it to me. The construction has been and is being done by shri Arun Maini, the father-in law of shri Saurabh Malik.
During the construction process, I had noticed certain irregularities and since the copy of the sanctioned plan was not handed over to me, I approached MCD authorities through my letter no. RM/MCC/131 dated 08-02 (Copy enclosed as annexure-I) and DKM/MCD/132 dated 08-03 (Copy enclosed as annexure-II), under RTI Act; for a copy of the New Plan and other supporting documents. The documents have been received by me from MCD authorities recently.
I found following irregularities:
1. That the Mutation of property letter no. Tax/WZ/Mut./406/248 dated 02-02 (copy enclosed as annexure-III)), issued by the Building department, MCD has been obtained on fraudulent and forged documents like an Affidavit and NOC Copy Enclosed as annexure-IV) showing my false signatures along with the application submitted by Mrs. Veena Malik wife of late Shri Surender Kumar Malik.
2. That Mutation of property letter no. Tax/Wz/Mut/257/245 dated 28-05 (copy enclosed as annexure- V) issued by the Building department, MCD has been obtained on fraudulent and forged documents like Affidavit (Copy enclosed at annexure VI) and Indemnity Bond (Copy enclosed as Annexure-VII) showing my forged signatures along with other false documents and the application submitted by shri Saurabh Malik son of late shri Surender Malik and Mrs. Veena Malik.
3. That the new building plan as sanctioned by the MCD authorities on 12-07 has been obtained on fraudulent and forged documents showing my false signatures along with the application submitted by shri Saurabh Malik son of late shri Surender Malik and Mrs. Veena Malik.
That I had submitted an application to the Deputy Commissioner of Police, Rajouri Garden, SHO Rajouri Garden and Deputy Commissioner MCD, West Zone Rajouri Garden and other authorities vide my letter no. DKM/58/RG dated 17-02 (Copies enclosed as annexture VIII, IX and X respectively)
That I am 75 years old man suffering with deceases and unable to walk. In view of the above, I request for your kind help as under:-
1. That further construction by shri Saurabh Malik on the said plot should be immediately stopped and the Building Plan dated 12-07 be cancelled.
2. That thorough investigations be carried out on the question of fraudulent and false documents as mentioned above, submitted by Mrs. Veena Malik and shri Saurabh Malik showing my forged signatures.
3. Any other action as deemed necessary, as per law of the land, should be taken.
