Sub – Illegal BCC (Building Completion Certificate) obtained by Mr. Sunil Kumar Prasad on Plot No. X-34, M.I.D.C., Hingna Industrial Estate, Nagpur (M.S)

Ref – Our letter to your Additional Chief Engineer Nagpur on 29/11 and 13/12

Dear Sir,

Regarding above cited matter I would like to inform you that, the officials of MIDC Nagpur without conducting any spot inquiry about construction over Plot No. X-34 M.I.D.C., Hingna Road, Nagpur has issued BCC on the basis of fake papers submitted by Mr. Sunil Kumar Prasad.

It is also informed you that the said plot was allotted to Mr. Prasad for the purpose of Hardware shop and the lease deed Dt. 2/1/1997 was dully executed. As per the terms of the said lease deed it was incumbent on part of the leasee to construct and start commercial activity within specified period. However the above leasee since neither constructs building nor start business activities till today, though the concerned MIDC officials has issued BCC.

As per the matter highlighted in newspapers the land was lease out to Mr. Prasad for the period of 95 years at marginal rate of Rs. 2.30 lacs only and Mr. Prasad is going to sale the lease land for Rs. 85 lacs. Though the said land was not allotted for land trading or capital gain purpose and he is not entitled to sell such land for his own benefit for capital gain.

The above licensee/plot holder originally belongs from Orissa State and from last fifteen years he does not residing at Nagpur, then how he is entitle to acquire such land in Maharashtra State, when the agriculture land was acquire by the Govt. from the poor farmers for the purpose of Industrial development in Maharashtra State. The said plot was reserved for commercial purpose so that the unemployed interesting persons in State could construct building and start business. Under the circumstance how the MIDC officials can allot land to out siders instead of unemployed persons of Maharashtra State. It was also incumbent on part of MIDC officials to verify the domicile of said licencee, whether he was really permanent resident of Maharashtra. The MIDC authority is not agency to acquire the land from poor farmers and to allot the same to any out siders at premium rate.

It is respectfully submitted that the land for which purpose acquired by the Govt. from the poor farmers on megar value the purpose of development could not be served because of such wrongful allotment, means to be misused of the land and because of such illegal allotment. The officials for the reason better known to them did not bother to take appropriate action against such erred lease holder. There are about 10% to 15% erred lease holders who have not still operate their business or industrial activities for which purpose the valuable land was allotted to them. As a result most of the industrial / commercial plots in MIDC area either to vacant or misused for another purpose. Moreover, most of land holders are alienating those land for their own capital gain resulting huge financial loss to the MIDC and Govt.

When the matter was published first time in newspaper “Lokmat” and “Dainik Bhaskar”it was found there a puncture shop was carring out on said plot of Mr. Prasad though it is not permissible. But after highlighted matter in newspapers Mr. Prasad had removed it immediately from Plot No. X-34 M.I.D.C., Nagpur. Also the plot of Mr. Prasad is very much close to your Division No 1 Office of Nagpur M.I.D.C. but your officer did not taken any action against such erred plot holder and deliberately eye sighted the issue with hand in gloves to Mr. Prasad

To acquire plot in MIDC on concessional subsidised rates and hold it for such long 10 to 15 years without any activities and sale at increased prise as per market rate now become the business of such type peoples like Mr. Prasad. (Mr. Prasd is example like such a deal)

As per the newspaper, it is also submitted that the Mr. Bharat B.Tapase is a bogus Architect (Till today he is not registered with council of Architecture, New Delhi). Without obtaining registration number from council of Architecture, New Delhi no one permitted to introduce himself to be an Architect. Your officer has not verified properly the papers submitted by Mr. Prasad whether it was legal or bogus. (Encl. COA’S web copy for your ready reference) It is also pertinent to note that, the MIDC officials without verifying the authenticity or competency of the said Architect to issue such BCC they erred to relay upon such certificate of architect and regularise the construction of Mr. Prasad, though he has never constructed physically any structure on the plot allotted to him by MIDC.

As per the newspaper your Executive Engineer of MIDC Mr. Akulwar always denying that he did not know about Mr. Prasad who is going to sell the allotted land or not. In his statement in newspaper he had told that if the Architect is bogus then he would file a complaint against Architect. But instead of filling complaint against said bogus Architect, why the officials are not recalling the plot or cancel the lease? Why your officers is still favouring Mr. Prasad by giving such statements. It means that your departmental officials are very much aware that said BCC was illegal, Architect was also bogus and from last 13 years the plot is in vacant position, even they are still favouring Mr. Prasad.

We are enclosing herewith some cutting of newspaper i.e. of Lokmat (Marathi) published on 9/12, Dainik Bhaskar published on 10/12 and Dainik Bhaskar published on 24/12 for your reference.

It is therefore requested that the appropriate action to revoke aforesaid lease may kindly be initiate against Mr. Sunil Kumar Prasad and then allot the same to any interested unemployed person in Maharashtra. Also initiate enquiry against responsible negligent officials of department to protect the interest of State and department too.
