Secretary sells the flat without clearing the previous delayed accounts & hands over the post of secretary without any AGM

Despite repeated requests & written applications for the accounts of the last 3 years, the secretary Mr. Ketan Diwecha, residing in flat no: A/1 or the Chairman Mr. M.S.Desai residing in flat C/33 or the Treasurer Mr. Atin Shah residing in flat B/43/44 or the other committee members of the above mentioned CHS haven't showed any balance sheets for the financial year 2009

When asked about the details of the funds specially collected for repairing of society, which is left incomplete everytime & the water leakage problem still prevails, the secretary shows us some bundles of rough papers which lack proper approval & stamps, & no mention of where it was used & no correspondent vouchers of the same.

All the payments are made in cash, as much as the amount of Rs.80, 000 & above for which there are no proper bills except for the rough hand written receipts on blank papers.

When asked for proper papers, they asked for a period of 1 month to show the same i.e. March

After which the proper meeting was never conducted.

The society members do not get the copy of the minutes of the Annual General Body Meeting of the society.

When asked for the previous accounts and the minutes of previous AGM, the members have never been shown that.

They always had excuses.

There are no proper bank records or statements of any of the transactions or payments made.

When asked for it, the secretary explains it saying that he is taking advantage of saving taxes by dealing in cash.

After all these things, without conducting proper election by the members of the society

the committee sends a circular in the society exactly as follows:

'As the committee meeting held on 7th August. In this meeting The secretary of the society regine (by which they mean -resigns) as has sold his flat and Mr. Atin Shah as also regine from his post treasurer due to this. Mr. Dinesh Mishra the managing committee member had proposed Mr. Vinod. R. Kavaiya. Flat No:-A/1 Secretary and seconded by Mr. Bhupendra Gandhi and Mrs. Harshidaben Anandjiwala had proposed Mr. Nitin Parmar Flat no:-B/42 as treasurer and seconded Mr. Prakash Mistry. And Mr. M.S. Desai continues as the chairman of the society. All the committee member agreed the same.'

I would like to know

1. if the secretary Mr. Ketan Diwecha could sell his flat and resign from the post of secretary without showing the proper books of records, without informing the society in a formal meeting or prior notice

Also would like to know

2. if a new secretary can be elected without any proper intimation or notice & without the 100% consent of the committee members. and without 0% consent of the rest of the Society members

They now tell the members to forget about the previous improper accounts and want all of them to go for the redevelopment of society

3. What should be done in such cases, Should such people be trusted and handed over the property worth crores for redevelopment.

4. What about the member's money which they have paid for the repairing funds & no repairing is done, in fact it has done more damages, for which the committee says that the fund is totally utilised, also our sinking funds (exact figure don't know as they are not showing any accounts)
