Delay in Project

I have invested with the builder in 07 in opera gardner project, and was given the assurance that we will get possession in three years. But till date construction didn't started in my tower. I have approached the builder for n number of time for the refund but all in vain. I have invested 6lac with the builder, if i would have invested in some other instrument it would have given me good returns.
