Delivered poor quality of work and did not delivered whith in the agreed time

Dear Sir,

My name is Rajendra Kumar Choubey. I have made an agreement with M/s Durga constructions, Janjgir (Champa) Chhattisgarh. (Proprietor Mr Ashutosh Sharma S/O Shesh nayran Sharma naer Shivva mandir Chandina para Janjgir Mo No – 9981133251). As per the Agreement (made on 50/-Rs Stamp Paper) for construction of first floor area 1090

@ 550 /- Per Sq-ft including Tube well excavation, Submersible pump fixing and ground floor tiles fixing, all activities should be completed within 4 Months.

Payment conditions as per agreement.

1) 35% of the total cost up to Bottom of Slab including fixing of Door and Window Frames..

2) 35% of the total cost up to casting of roof slab, parapet walls, plastering both inner & outer sides, sanitary works, railing & windows grill fixing.

3) Balance 30% of the total before starting Tiles, POP work, Door window fixing and color washing.

4) The total stipulated time for completion of works is mutually agreed as 4 months.

Contractor has started the construction in the month of October. as per agreement first installment Rs 2 Lakhs has been paid within a month to the contractor, to finish up to Slab bottom level, but he completed the Slab bottom level in the month of Feb. (Except Door and Window frames). 4 months abnormal delay has been done by the contractor because of nonpayment to Labors and material suppliers. Many times direct payment to suppliers and labors has been done by me for smoother flow of work. As on date the total partial payment done to contractor by me is Rs 471000/- . Against the Total cost as per agreement Rs 5, 500, 00/-(Except ground floor tiles work 1000x50=50000/-). Seven and half month has all ready passed.

Pending work in House

1) Inner plastering 25%/Outer plastering 100% Rs 45, 000 /-

2) Tiles fixing on first floor including stair Rs 70, 000/- (Kitchen and toilet block tiles dumped on site)

3) Door and window making and fixing with grill Rs 40, 000/-

4) Railing in parapet wall and stair Rs 25, 000/-

5) Signatory work and Electrical work Rs 25, 000/-

6) POP work and Color washing charge Rs 45, 000/-

7) Kitchen ply wood works and show case Rs 35, 000

In spite of numerous requests and reminders, the contractor failed to stick on to the agreement causing abnormal delay in completing my house. He is even reluctant to answer by any means and even not responding to any of my communication. Delivered poor quality of work and did not delivered whith in the agreed time. Therefore I request you to consider this letter as a complaint and take necessary action on the builder.and publish your news paper
