Earth Infrastructures appears to be a totally unethical company. They do not appear to have any sense of wrong or right.
I am seriously considering them of taking to court (Consumer or otherwise)
Dear Sir please go through my problem and advise how I can file a complaint/case against them in consumer or other court. I am ready to bear the expenses.
Following is my problem

I had booked a 3BHK, 1195 sq. ft., flat in Earth Towne on 22-Jul under CLP plan.
Although I had booked this flat under CLP but I got regular demand
letters from EarthInfra saying that my booking was under Flexi plan. I
had called various numbers on different occasions listed on demand
letters for correcting the anomaly but unfortunately no action was
taken by EarthInfra.
I have come to know that areas/prices of the units and layout/theme of the
project have been changed but none of this was communicated to me.
Sometime last year in Aug-Sep, I got a call from EarthInfra saying
that my flat under original booking was not available and that I
should contact Earthinfra for fresh allotment. After that I got a
letter from EarthInfra on 28-Sep saying that my booking has been
cancelled due to non-payment of dues.
I visited Noida office of EarthInfra on 13-Dec for refund of my
money and met Mr Sameer Khan (Manager-Customer Care Unit). Mr Sameer told me that my money could be
refunded if I brought signature proof from my bank and NOC from Unicon
broker. He also told me that NOC was a routine affair and that I
could get it easily. Just want to add that Miss Ranjana was the
EarthInfra's representative when I had originally booked the flat.
As suggested by Mr Sameer I visited Unicon’s office for NOC.
There some Mr Khan assured me that I will be given NOC once he had talk with
EarthInfra’s representatives. After that I routinely followed up
with him but he did not gave me any convincing reply.
Now Mr Sameer is saying that I will have to bear the brokerage charges EarthInfra has paid to Unicon and that
no interest will be paid to me on my money.
Following is my view of the situation.

I do not have any
agreement with Unicon and have not done any transaction with them.
Neither Unicon nor EarthInfra have provided with me any service or
product. Till then not a single correspondence has taken place between
me and Unicon.
I don’t know if it is my responsibility to get the NOC and if the onus
is with me then why Earthinfra and Unicon are delaying it. In any case
my responsibility should be limited to paper work and EarthInfra and
Unicon should take care of the rest since they are the one who did the
transaction, if any.
I have now visited Unicon’s office thrice (once “real estate” arm of
Unicon was closed and last Saturday (4-Feb) when I visited the office,
I came to know that real estate arm has been shifted to separate
facility.). I have visited EarthInfra’s office twice. I have made
close to 30 phone calls. On last Saturday, 4-Feb neither Sameer nor
Ranjana were at office. Ironically the booking was done in one day.
I do not want to pay any money to Unicon or
EarthInfra because neither of them has provided me with any service or
product. I have no written agreement on tariffs or cancellation charges with either Unicon or
EarthInfra. Instead I have lost the interest on my money to
the tune of 35000 rupees (2.3 lakhs at 9% p.a., 1.5 years).
