Delay in Possession of Flat

Dear Sir,

I booked a flat in IRIS of Everest Countryside a project being developed by Everest Developers on June 02 and final disbursement of payment is paid to Builder on July 03.

After final payment final Snag list is being cleared mutually on July 31.

Since then the Builder is not clearing possession of my flat due to VAT which need to be paid. But builder is not giving any clear guideline for clearing the same.

Please advise me whether builder can delay the possession for such reason.
