Sold as single combo flat and registered with Municipal Corporation as two different flats

I bought a (3-1/2 BHK) flat admeasuring 1245. sq.ft as a single combo flat, for my son from HDIL (Housing Development and Infrastructure Ltd) in Dreams Complex, LBS Marg, Bhandup, Mumbai 400078 about 5 years back. The stamp dutyand the registration were all done asshould be for a sigle flat. I have also paid the purchase price for 1245.sq.ft area. They were also collecting the maint. charges @ Rs.3/- per sq.ft per month for 1245 sq.ft.till August. But while handig over the building to the coop. hsg soc.in August they have shown the HsG.SoC. as two individual flats of 1BHK (AREA 620 sq.ft.each) In the sale deed it was mentioned as 80.96 sq.tr. carpet area and the agreement is also only one. They have never shown in the agreementand as 2 x 40.48sq.mtr.flat. They have not made two different agreements.

Moreover they have not provided the followings which should have been given if they had sold as two 1BHK flats:

1.There is only one Main door at the entrance; instead of 2 entrances.

2.There is no separate kitchen, with platform sink etc. which a basic requirement for a flat.

3.There is only common toilet in the above flat as againsgt the two provided to other 1 BGHK flats.

4.There is only one hall and not two different halls as should have been for two 1 BHK flats.

5.There is only on MGL connection. (Rs.5000/- for single connection was collected by the builder at the time of agreement)

and there are so many other things that are not provided, since they have soled this above as one single flat.

The Housing was was formed in Nov.2008 and the builder had handed over the building to the Society in August. Till such time the maint. charges were recovered from the members at the rate Rs.3/- per sq.ft per month.

Now the Hsg. Soc. is charging two different Maint. charges at a higher rate (i.e approx. Rs.6.50 per sq.ft per month) as the builder has shown them the plan as two different flats of 1BHK instead of 1 3-1/2 BHK as told and sold.

You will understand that this act of HDIL is a breach of trust and I therefore request you to take up the matter with the builder and assist to recover extra amount I have paid towards the cost of the flat i.e. approx. Rs.14750/- and the cost for the amenities they have not provided and the expenses I may incur to convert the above flat into 2 x 1BHK as it appears in Hsq. Soc. records.
