Hi Sir/Madam,
I have a Flat booked in the project PAN OASIS at sector-70 Noida (dated 14-10-09).i have made the intial booking amount of rs 3 lacs.
There is some discrepancy in the amount at which the Unit was booked and at which it is allotted. When I asked for a clarification on the same, they (People from Amrapali and Pan Realtors) said that there is a PLC of rs 200/sq ft is applicable to the unit (which was not there at the time of booking). Which I was never told about and there is no mentioning of such a (roof/terrace) PLC in the application form itself. I have refused to pay the terrace PLC as it is not mentioned during booking.
I have visited PAN office 5 times, but there is no favorable response from them. They don't even entertain me and they keep me waiting for long hours and treat me as if i am on the wrong side. This is disrupting my other professional and personal commitments. They have gone to the extent of saying that if you don't pay the said amount, your booking will stand canceled. This makes me feel denigrated.
I have not returned the signed copy of the Allotment letter (due to the discrepancy in amount) to the PAN Office. Also I have not signed the Flat Buyer Agreement.
Payment was made through cheques. I have the cheque numbers and the payment slips with me. I can produce an e-copy of all the relevant documents.
Until the issue is resolved, I can not Sign the Flat Buyer Agreement so the 30 days period to sign the Flat Buyer Agreement should not Apply here till the issue is resolved. The same has been communicated to PAN Realtors through Email (though they have not acknowledged).
The Terms and Conditions that I was told (also mentioned in the application form) at the time of booking are as follows :
1. Sold unit will not be charged any escalation (as mentioned in the payment plan).
The flat is booked by Invesntor'sClinic Noida. And now they are not backing me up.
Please help me in this regard and suggest me what action should i take? I don't mind registering a complaint against them.
