Efund of excess amount collected after migration from postpaid to prepaid

1. I have paid Rs. 3480/-

2. You have refunded Rs. 238.22

3. Either refund remaining amount or render account for remaining amount

MY ACTUAL CASE: WHAT YOU HAVE TO READ (!)

In this connection I have to reiterate that:

a) ) I have paid all the dues i.e. my monthly bill and the fraction of bill up

to 28/09.

b) Mr. Santhosh of Habshiguda franchise had issued the subscriber's

receipt.(which I am enclosing now as per your request)

c) After my going to US my daughter Dr. (Mrs.) Pallavi had visited the

Habshiguda Franchise several times and pursued the matter for migration. She

has been told that Mr. Santhosh had left the Airtel job and it seems he had not

put

up my request for migration.

Thus: I) Bharti Airtel Ltd., had failed to control over its executive Mr.

Santhosh that he had not prefered my request for migration from postpaid to

prepaid

since 28/09. After laps of 7 months Bharti Airtel Ltd., is asking the

customer to submit the acknowledgement receipt (!).

2. In your reply you have evasively stated that Rs. 3480/- has been billed

according to usage and hence the bill have been generated without rendering

item-wise detailed account which will reveal that

II) Bharti Airtel Ltd., had failed to update the customer request and claimed

wrong bills by hiding its employees mistakes and put the consumer into loss.

3.You have stated in your reply that there is an excess amount of Rs. 238.22

for which refund request has been taken.

III) As a matter of fact the refund will be more than that amount, if once it

is agreed that my request for migration from postpaid to prepaid was not taken

into account by the failure of duty of Bharti Airtel Ltd., employee (Mr.

Sathosh as per the acknowledgment receipt) and thus wrong bills have been

generated by hiding its employees mistakes.

4. You have not replied to my query that Bharti Airtel Ltd., had failed to

supervise the duties and responsibilities of its executive Mr. P. Ganesh Babu

who had collected the amount of Rs. 3480/- on 17/03 and had not updated

until 05/04 and put the consumer in distress, on which

date the cause of action arisen.

IV) I have requested to provide me a copy of Rules/conditions of Bharti

Airtel Ltd., wherein the mobile services of referral person (i.e. my daughter

Dr. V. Pallavi) will be deactivated if a customer is failed to pay the bill

(of course wrongly claimed by Bharti Airtel Ltd.,). Because one of employee

working in Legal Department of Bharti Airtel Ltd., had threatened my daughter

Dr. V. Pallavi, over phone that her Mobile Phone No. 9866078136 will be

deactivated if my bill (which was wrongly claimed) is not paid.

6. Thus it is construed that you have not been able to address my query

suitably.

7. I am submitting the document as requested in your mail, without prejudice to

my right to contemplate legal proceedings against Bharti Airtel Ltd., in the

Consumer Court, if you are not addressing properly my grievances stated at I,

II, III & IV above.
