TERMINATION OF MEMBERSHIP

1. Brand name ‘ MAHINDRA’ was the single most important factor when we decided to take CLUB MAHINDRA HOLIDAYS membership on 31 Dec. My association with company in the FARM SECTOR for 35 YEARS was the best guarantee. We trusted every written or spoken word of your executives.

2. On receipt of membership documents/card etc, we discovered certain discrepancies in the promised and written facts.

(a) We were promised additional gift vouchers of SHOPPERS STOP of Rs 3000/-. The sales executive MR. AQUIB at ANSAL PLAZA, ANDREWS GUNJ, NEW DELHI informed us that it was a special offer if we took the membership on 31 Dec. And, since, he had run out of the stock, the gift vouchers would come by post along with other membership documents. He also offered to drop these vouchers at my residence in Dwarka. We had no reason to suspect the offer or the executive. However, we have not received these vouchers so far.

(b) A 60 months payment plan was recommended, which we accepted. After the Govt discount and other incentives, an amount of Rs 216121/- was worked out towards 25 years membership, against which we paid Rs 25126/-. Also, EMI Rs 4739/- was fixed. However, at NO STAGE did Mr Aquib or his senior (Mr SAJID - I guess), mention charging of interest on EMI. The interest is levied on equated monthly installments (EMI) for the period of default or delay ONLY.

(c) ASF of Rs 8043 /- was explained. But it was never made EXPLICIT that it was to be charged ‘irrespective of usage’. We carried the impression that it was to be paid only in the year of usage. Well, this could be our poor understanding but such vital aspects ought to be made clear to ‘not so knowledgeable customers who are venturing into such contracts for the first time and do not understand nuances. Voluminous and legally fortified terms & conditions are always not possible to be read and understood then and there. Besides, sales Wizards apply every trick in the book, some times at the cost of ethic and name of the company.

3. All this was taken up with Mr Aquib by my wife. For about a week, Mr Aquib kept assuring her of action. But nothing happened and there after, he stopped taking her calls. On my asking him the progress, he advised me to get in touch with his superiors as it was not his job to settle such issues. When I confronted him as to why he made the promise of free gift vouchers, he asked me in a very rude and insulting manner to produce the documentary evidence of his promise. Similarly, when asked as to why the issue of charging interest on EMI or payment of ASF IRRESPECTIVE OF USAGE was not explained properly, his reply was most derogatory. He said ‘Boss, you didn’t ask me, so I did’nt tell you’. He had no answer to my argument that how SHOPPERS STOP came to my mind and if the interest on EMI was explained properly, we might have taken an interest free option avoiding excess payment of Rs 90, 000/appx towards membership.

4. I sought Mr Sajid’s help. He heard me out and promised me to visit my place with Mr Aquib. Unfortunately, even after reminders and repeated shifting of date & time for meeting, he did not turn up. Another senior person (Mr. Sanjai-I guess), told me that the gift vouchers had been received by Mr Sajid who was in Chennai for official work. Mr Sanjai also offered to come to my residence on a particular date & time, but he also kept on shifting the meeting on the pretext that he would only come along with gift vouchers after Mr SAJID returns from Chennai. Sadly, we did not hear any thing for them thereafter.

5. Frustrated, we decided to visit MAHINDRA TOWERS at Bhikaji Kama place on 05 Feb10 (Friday) and wanted to meet Mr. Midha. We were told at the reception that Mr Midha was not in the office and they did not have his Mobile number. (Fair enough, I do not know whether it was company policy or my case did not merit his attention). Ms Shikha attended to us. I also spoke to Mr Sanjiv Kr.(I guess I/C Delhi region), who asked me to meet him on 06 Feb 10 (Saturday). However, later I was told that Mr Sanjiv was committed elsewhere and would see me only on 09 Feb10 (Tuesday). As I was going out of station, I requested Ms Shikha to re-chech if Mr sanjiv could accommodate me on 06 Feb10 any time. Ms Shikha did call back saying that Mr sanjiv has now agreed to meet me on 06 Feb and would give 1/1-1/2 hr notice so that I could reach the appointed place of meeting on time.

6. On 06 Feb, when I did not hear either from Ms Shikha or Mr. Sanjiv till 2 PM, I called MAHINDRA TOWERS . The phone was Answered by Security who informed me that Saturday being half day, every one had packed up. I called Mr Sanjiv on his Mobile a number of times, but my calls were not answered. Finally, I sent him two messages, where in he graciously conceded to my request and wrote that he would call me at around&& (no time given). I waited through whole of Saturday waiting to hear either from Ms Shikha or Mr Sanjiv. Appalled, I am wondering as to where the buck would stop.

7. We feel very humiliated by the conduct of various functionaries at every level. Unparalleled apathy, providing information selectively and gross neglect of ethical practices by sales staff (in the name of meeting the targets) compels me to think whether the Company MAHINDRA deserves such people. In the final analysis, it is the company’s name that will take the beating and not the staff (which always seeks greener pastures).

8. Under the circumstances, I find it difficult to continue with the membership. If at the outset we can be treated like the way we have been, who knows what will happen in future.

9. Please take action to discontinue EMI payments (ECS) from my a/c No. 91182030002310 at Syndicate Bank, 27 ED, AIR FORCE, PINTO PARK, PALAM, NEW DELHI. Also make arrangements to refund the entire amount paid by me so far. Also advise me before hand the deductions, if any. The refund cheque can be sent to the same bank above in the name of GP CAPT PK GUPTA.

10. In convenience is regretted. Let me make it clear that I have tried my best to avoid taking such step, but in vein.
