Social Activity Fees

Till the last quarter our co-operative society was NOT charging 'SOCIAL ACTIVITY FEES' for un-occupied flats. But from June'12 Quarter the society has been charging SOCIAL ACTIVITY FEES OF RS 300 EVEN FOR UN-OCCUPIED FLATS. When i wrote to them that Social activity fees is NOT applicable for un-occupied flats they replied that a decision has been taken in the Managing Committee Meeting and the same has to be paid. Kindly clarify if payment of this fees is mandatory for UN-OCCUPIED flats. Is the said collection legally bound.

Kindly clarify mentioning the section clauses applicable so that i can reply to them.
