Misrepresentation of product and even upon cancellation of the oders, debit card still charged for the products price

I had placed Order No. 71442 and Order No. 72618 in the month of September for mobile phone viz. “Black Berry Curve 8520” along with my office colleague. Eventually, my office colleague received the product before me and i came to know that the company GIFT360 was grossly misrepresenting the product sold by Kaviraj Housewares and was cheating customers at large giving false information on their website and also on phone when i was placing the order on its Shop by Phone, toll free no. 1800-425-1120.

For the payment, I provided my credit card details of my Citibank Credit Card. The transaction was processed in equated monthly installments divided in six months. 0% EMI basis was to be charged to my credit card every month. Infact i was informed specifically while placing the order that the mobile phone viz. “Black Berry Curve 8520” will be operational with any GSM network providers. However, when my colleague received the product, I was shock to know that the handset could only be used with Airtel and no other network provider. I immediately called Gift360 on its hotline and told them that since the specifications represented to me were different from the actual product and therefore, I wish to cancel my both orders referred above. I was assured by one Mr. Akilan that since, nothing was dispatched, both the orders were cancelled and that no EMI would be levied on my Credit Card.

After few months, i happened to talk to an executive from Citibank Credit card Department who informed me that 3 instalments since September have been debited on my credit card even after cancellation of the order and confirmation from your end and considering the fact that no product has been delivered to me.

They misused my credit card information and have fraudulently charged three EMI’s in regard to the above referred orders. Now, when i confronted them upon this issue they further said that the EMIs are wrongly charged on my credit card and that they can only reverse these amounts after the entire EMIs are debited to my account i.e. after 6 months.
