After owning a TATA Safari for 4 years, we decided to buy another TATA Car aswe were happy with TATA vehicles inspite of hearing a lot of dealership andservice complaints. Hence, being a Loyal Customer of TATA, we got the Mostridiculous reward from TATA dealer – OM SAI MOTORS PVT. LTD. Kandivali.

On 27th of June, I called up OM SAI and asked for TEST Drive of aMANZA Vehicle. Promptly a Sales Executive – Mr. Hemant Gaikwad, came along withan ELAN Variant within few hours. I took the test drive of the vehicle and wasquite impressed. My primary objective was to drive the car between Mumbai andPune & within City for business purpose and over the weekends for familyouting. As I have driven many vehicles and the last vehicle being Safari, I wanteda vehicle with both Comfort and milage. However, I didn’t need a ABS or Airbagsas they were not part of my necessity. While taking the Test Drive, Idiscussed with Mr. Hemant Gaikwad features available in other variants.

Mr. Gaiakwad handed over a brochure to me which had various features mentionedin it. New AQUA was completely out of question for me as it didn’t have most ofthe required features that I was looking for. I finalized on New Aura as it hadall the features I wanted in the car (as per the brochure given to me) exceptthe Height Adjustable Driver’s Seat which I decided to live with. As payingRs.43000 extra for just an Adjustable seat was not what I was willing to gofor. As I have a back problem, I wanted a vehicle which has Lumbar Support& Tilt Adjustable power steering as main features for the car which I wouldbe driving. I specifically asked Mr. Gaikwad for these features, and I was toldthat these features are available in all the Variants including New AQUA whichhe pointed out in the brochure. Finally, I asked him if he can arrange a NewAura Model for Test drive, and he said that it wasn’t available with him.

As a layman I believed him and did some research on internet on Tata’s own site (PrintscreenAttached), Carwale.com (Printscreen Attached) & Team-BHP. Everywhere I gotthe same feature list that I wanted. So, with full faith in all these sites andmainly in TATA brand, I decided to Book a Vehicle with OM SAI MOTORS PVT. LTD.Kandivali West.

On 29th June we booked the vehicle with Om Sai Motors Pvt. Ltd. as they told us that they have special offer till 30th of June.

We booked the Tata Manza Quadrajet - New Aura – BS IV – D.White - withan EX-Showroom price of Rs.680721/- and on Road price of Rs.769069/- by payingRs.51000/- via Cheque No. 283545 Drawn in favour of Om Sai Motors Pvt. Ltd. In theName of Smita Patange (my wife) from her Axis Bank account.

We told the dealer that we will take the delivery on 15th Julywhich was a Guru Pornima – an Auspicious Day.

After making a final payment, we were given the delivery of vehicle as promisedon 15th July by the dealer for which, we were very happy.

Though, I immediately identified following problems in the car and informed thedealer via Mr. Hemant Gaikwad.

1. Check Engine Light was ON constantly

2. Film placed on Left side Windows had come out.

Mr. Hemant asked me to visit the OM SAI MOTORS’ Service Center at HindustanNaka, Charkop to get the issue sorted with the Engine Light.

When I took the vehicle to the Service Center, I was told that there was someissue with the Software that checks the car I was told to bring the car back onfollowing Wednesday. When I approached them on Wednesday, I was told that theSoftware is still not ready. And I was assured that its not an Issue and Ishould drive without any tension.

Finally, on Saturday, 23rd of July I decided to drive the carout of the city for a long drive to a destination called Lavasa. Once wereached Mumbai-Pune Express Highway after Panvel, I decided to Adjust theSteering so that I can drive Relaxed way as I knew that there won’t be much gearchanging now as it’s a continuous stretch till Pune.

However, to my surprise, I didn’t find the Tilt Adjustment option below theSteering Unit where it was earlier shown to me. I got out of the car andchecked thoroughly. And to my surprise, I didn’t find it again anywhere.

I called up Mr. Gaikwad, however, his number was Busy. I tried once again, andit was unreachable. I decided to continue to drive as we had a booking made atLavasa and didn’t want to ruin our weekend.

So, I drove the car further by adjusting myself with the uncomfortable drive. Againon our way back to Mumbai on Sunday, I tried calling Mr. Gaikwad where hedidn’t answer the phone.

I continued an uncomfortable drive back to Mumbai. It was overall 450 kmdrive in such an uncomfortable posture. After this uncomfortable drive I end upwith severe back pain.

On Monday, July 25 I visited my orthopedic who informed me not to drivethe car any further without getting the Steering fixed.

I immediately contacted Mr. Hemant Gaikwad again and he answered the phoneimmediately, where I told him about the problem I had identified (NonAdjustable Tilt Steering) and to my surprise he said, that there are a fewchanges to the Vehicle’s variant. I reminded him about our discussion duringthe Test Drive and lateron at his desk and the Brochure that he had handed meover. He said, that he will check with his senior and get back to me. Afterthat he has neither called back nor has answered his phone.

I immediately called up TATA Motors, corporate center on 022-66561600 listed onthe Website and asked for the concerned person, the attendant gave me anothernumber to call up – 022-66930400/401, who further redirected me to onemore number - 9029000717 – Mr. Chetan Sarvaiya. As I spoke to him to confirmthe same, he informed me that the Feature is discontinued from 1stof June onwards. I asked him, what should I do now as the dealer didn’tinform me while selling. He told me that, I cant do anything with that. Youhave to sort it out with the dealer. Pl note that the dealer at no point oftime has disclosed or made us aware about the discontinuation of the saidfeature.

I once again called Mr. Hemant’s Number, however, he didn’t answer the phoneand didn’t even bother to call back.

I feel that I have been cheated by not disclosing the correct facts about the vehicle variant.

The Adjustable Tilt Steering is the necessity forme in order to drive in a comfortable position. Now the same has already caused me the physical hazard and mental harassment.

I lodged this complaint with TATA Motors - through the Website and got a reply as below:

When we contacted OM SAI Motors, there was no person named DEVYANI NAIR working with them.

Further, a person from OM SAI said that he will look into the matter and till date - exactly after 1 month, we dont have any redressal for the issue.

The Sales team has stopped answering our phones too.

Please look into this.
