Refused to handover the passport

We are a consultancy based company in Mumbai. We have many employees travelling every month to different countries through Emirates. The director of our company had lost his US passport. We completed all the formalities with FRRO and American consulate to get his new passport made and exit formalities completed as he was flying to US. He also had an Indian OCI card with him. On his way back from New York to Mumbai, he was allowed to board the flight from New York by the emirates authorities. He was denied entry into India, as he did not have the U visa sticker which was affixed on the lost passport, though he had the original OCI card. If the visa documents were not complete, why did the emirates authorities allow the passenger to board the flight in first place. Inspite of it being the airlines mistake, the passenger was made to pay for the flight (in which he was sent back from Mumbai to Dubai) forcefully by refusing to handover the passport. The crew of the Emirates was very rude and non cooperative with the director of our company. Will Emirates pay flight charges back for their mistake of not checking the passenger's travel documents?
