This issue is regarding a garment (Black Jeans - Trouser) purchase from Kay Sons on 11 Feb '12 around 3
5 PM of Rs 450/-. I also purchaged one suit Rs 2700/- a shirt Rs 600/-. Since it was Saturday and shop
was too crowded and couldn't able to do a trial. But the sales man told me that it will fit in and color
won't fade, etc... trusting his words I purchaged it blindly.
There were one rude old lady cashier how collected the money and gave me a business card of her shop and
raw bill.
When I tried the Jeans at home the length was short. So I took it for exchange to the shop from
Fardidabad (Where I stay) to Karol Bagh on 15th Feb'12 afternoon around 2 PM. They first examined the
trouser and then said will exchange with another one, they shown me few other pices. But not of same
make or structure. Then I requested for a refund, then the lady cashier came and said she can't refund
my money. She then said this trouser is a used one and she has to talk to the owner of the shop before
exchange or refund. Then she said owner is not in the shop will come in evening. I waited for 30 - 45
minutes for the owner to talk but no one arrived. When I requested her to enquire when he (owner) will
be coming to the shop, she said she will not check on phone, owner can come any time before evening.
I got frustrated so I told then to keep the trouser with them at the shop itself if they will not refund
the money or exchange. I came back.
Is there a way to sue them for harashing or cheeting the customer. They never told me while purchanging
that they will not be any exchange or refund. on the shop they put a exchange options.
The business card shows Mr Deepak (Kay Sons, 6/76 & 78, WEA, Ajmal Khan Road, Karol Bagh, New Delhi 110005) and mobile number 9711397134 & 9968703831. I would like to sue them for cheeting and harashing customers and I need my money back.
