Refuse to exchange the defective woman garment (SKD)

Dear

Sir/Madam,

I am an Ex - Serviceman and now working as a Manager in Supply Chain & Logistic in Garment Sector, Mumbai.

I had purchased an woman Garment (SKD) for my wife from MEMSAAB BOUTIQUE, CENTRE ONE MALL, VASHI.(InvoiceNo.43440dt.13/03/10.Ph.02227811615.)

But as the product was defective we request them to change the same. They also agreed. But while delivering they give me a USED and other coustemer's garment named (digno subhash), please refer attachedphotographsforyourpersual.

When I said it is already used by someone because it is dirty, please give me a freshone they simply refuse to give us a freshone. When I said that I will complaint to the customer service, he said do what ever you want and don't come to our shop again for any purchase.

I had suffered my duties in my office too and had to take leave and pain of going there and asking for it.

I felt lots of embarrassment also asking for the new garment before other customer 2 times.

listing some notes present in their bill :

1) First time dry wash only.

2) Goods once sold will not be taken back.

3) Goods exchange time 11.00 am to 4.00pm

4) No Guarantee for colour.

5) No Guarantee for cotton/ Silk Fabric.

What is the logic behind note no.2, 3 when they are writing that Goods once sold will not be taken back then why they have offered note no.3, and 4, 5. Ok, I accept the no Guarantee for colour of Fabric it is not a branded product, but what about the No Guarantee for the Fabric itself? If their is no Guarantee of the Fabric how can they sold the Fabric. This is totally to deceive of customer.

If they are not able to give any Guarantee for the product how can they run a Boutique in a place like CENTRE ONE MALL. THIS IS THE INSULT OF A BIG MALL.

So, on 15/04/10 when he refuse to give me a exchange garment. I am writing to you and hoping that it will be properly justiced.

It is not that the price of the garment is too high that I can't bare a loss but it is my right as per the consumer low and I am fighting for my rights.

So, justice to this will be justice to all those customers who suffer such losses.
