BREAKAGE OF ITEMS TRANSPORTED & ITS NON COMPENSATION

Dear Sir,

This is regarding damage caused to the house hold items transported from Bangalore (Shivaji Nagar) to Kannur through M/s Patel roadways on 14 Apr vide LTR No 9973378 dt 14 Apr. The items were booked at Shivaji Nagar branch on 10 Apr with a promise that the items will be delivered at Kannur on 17 Apr. Eventhough I contacted their office at Kannur from 17 Apr onwards I could not get any reply from Kannur Branch and on 19 Apr they intimated me to contact their Ernamkulam branch regarding its non arrival. It is only after their intervention the items were transported from Bangalore on 20 Apr and finally it reached at Kannur on 22 Apr. However I could collect the items only on 23 Apr due to its non arrival. On inspection the following items were damaged :-

(a) Raja Deewan Kot worth Rs 15500/- each - Two Nos

(b) Turned leg worth Rs 390/- each - One No

(c) Dining Table Top worth Rs 4380/- each - One No

(d) Kot of size 61/2 x 5 ft worth Rs 7000/- each - One No

. On 22 Apr when inspected, the items were damaged. However the in-charge at Kannur informed me to contact the Ernakulam office who adviced me to intimate the extent of damage with a promise that they will look in to the matter and suitable compensation will be paid which I did and handed over to the Kannur Office. However after delivery of the items the attitutde of their office staff at Kannur and Ernakulam was totally indifferent and against the right of a sovereign customer. Now they pass the bucks to one or another office and finally they intimated me to contact their bangalore office for the compensation with a remarks that the items must not have been booked by the Bangalore branch as the items being house hold and partial load. This fact was never intimated to me while booking the items and now I am in a confused state as to whom I should contact for the redressal. Further when I asked for a certificate of damage from Kannur Office they literally refused stating that it is the Ernakulam office which is supposed to issue the certificate which has again send me from post to pillair. It would be appreciated If the Hon'ble Court could look in to the matter. I must mention here that the delay in delivery also cost me Rs 3000/- towards the daily wages of a carpenter who was waiting for fixing the dismantled items. In view of the above, I request the Hon'ble Forum to look into the matter and an order for payment of compensation to the extent of Rs.60, 000/- may please passed against the transporters towards the loss incurred by me and the mental tension emanated from the loss.
