COMPLAINTS AGAINST NATIONAL INSTITUTE OF FILM & FINE ARTS-KOLKATA, AFFILIATED TO THE FEDERATION OF THE FILM SOCIETIES OF INDIA.. AND A MEMBER OF FILM ARCHIVES - PUNE, REGD. NO: S/65383.

Take final notice on behalf of my client Sri Aloke Chattoraj of 208, Bhu-Basan, P.M. Bithi, City Center, Durgapur – 713216 as under:-

1. That Sri Aloke Chattoraj, my Client had sent you both, - separately, a notice with categorical allegations against you both with relevant evidence and copy of all documents dated. 08/12 regarding breach of contract and lot many illegal / motivated / activities / your callousness / irresponsibility / deputation of teachers / motivatedly made relation irritated with a view to extract extra money and stopped deputing lecturers / Institutional support by supplying necessary equipments / instruments to his Institute on your whims by intentional violation of stipulation & norms and thus the students of his Institute are deprived of training and their fate & future in thus clouded for your absolute callousness and irresponsibility, which is very injurious to the interest of newly set-up institution and which is breach of terms of Business among the parties, - through and by his Advocate Mr. Kazi K.A.Siddiqui of Durgapur.

2. But, you are both so adamant and injurious / harmful and serious in nature to the Society that no necessary steps / care has taken yet as directed and called for by my client Sri Chattoraj since more than 120 days for settlement and finally resolve the issues as raised in his letter dated 08/12 with copy of relevant documents.

3. Though, one your advocate has sent a letter with full of bull-sheet without any necessary document / evidence as required for, and failed to establish his explanation thereof, that’s why my client has rejected his all points as mentioned in his letter dated 30/12.

4. That it is understood from your advertisement & the news published in Ananda Bazar Patrika dated 8th. January that the institute of my client Sri Aloke Chattoraj at Shailya Niketan, 21-MNAV, Bengal Ambuja, City Center, Durgapur -16 declared & circulated as a Branch of National Institute of Film & Fine Arts, having its Office at 35A, Townshend Road, Kolkata – 200025, and my Client was become happy & glad in your initial effort & wish.

5. That my Client was very sincere about the future of the Students and the Institution, made a very close contact with you with a view to that paneled lecturers attends the Institute as per routine, but your ‘Modus-operendi” act after receipt of money and to extract extra money from my client.

6. That your act, performance as a General Secretary of the NIFFA. Kolkata, is not all fair & clean, and purposely, intentionally, motivated and your whims made my client very disturbed and the existence of the Institute of my client is at stake and my client shall have no other alternative than to file a Criminal case against you before the Competent court of Law at Durgapur for redress within one month from the date of this NOTICE.Even mt client may open along with multiplicity Suits where all the Office Bearer of your Institute shall be made Parties and they will be handled up before the Competent Courts of Law during the trial process of each case.

7. That unless you sit with my client for arbitration for settlement with a view to let the Institute survival and run smoothly within ONE MONTH of this notice, my client shall have no other alternative but to file a suit claiming damage of Rupees Twenty Lakhs and other related costs as on date from you for necessary realization.

8. That your act, performance as a General Secretary of the NIFFA. Kolkata, is not all fair & clean, and purposely, intentionally, motivated and your whims made my client very disturbed and the existence of the Institute of my client is at stake and my client shall have no other alternative than to file a Criminal case against you before the Competent court of Law at Durgapur for redress within one month from the date of this NOTICE.Even mt client may open along with multiplicity Suits where all the Office Bearer of your Institute shall be made Parties and they will be handled up before the Competent Courts of Law during the trial process of each case.

9. That my Client has invested under your instruction / committment for setting up of the Durgpur Institute plus day to day expenditure till yet and other various expenses which has already gone over Rupees Twenty Lakhs; inspite of that you did not handed over the UGC Registration Certificate, University Affiliation and other required Certification & Registration to the Durgapur Institute, though the requisite fees for all has already been paid to you at least a year back, under this situation, I am advised by my Client to file a demurrage suit against you for realization of entire expenditure right from the start of Durgapur institute to till finalization of the suit plus 18%interest of the entire amount thereof before the Competent Court of Law at Durgapur.

10. That till date you have not registered our Students, no class routine served, no session calendar and no other related institutional support - required equipments – studio floor equipments etc and finally the liabilities of twenty six nos. of students and their respective fate & future which is in very much at stake. Even you do not maintain and obey the Business plan. These types of motivated act & foul play attract a severe monetary demurrage, which my client takes necessary and appropriate legal action against your intentional, planned attitude. Thereby, no correspondence will be made to you further, except the legal shelter both in Civil & Criminal under the Competent Court of Law, Durgapur immediately, if your good sense will not prevail within 30 days from issue of this letter.

11. You are therefore advised to settle with open heart & in free mind with my Client in presence of all the Office Bearers for Arbitration and settle the issue by a month times from the date of issue of this letter. If you do not take any such initiative, my Client has the liability to take shelter of the Court of law and this is final.
