Trackpad not working for the last 9 months

I purchased Blackberry curve 9300 on 17-08 for 13, 500/- from an outlet in New Delhi, India (cash memo-3008). For the last 9 months my phone has been more with the service center than with me.

The first issue cropped up just 2 months after the date of purchase when the track-pad started malfunctioning. When I took the device to the service center I was told that it would be sent to Bangalore service center and I would be updated on the same. It was after 10 days when I called I was told that the device could not be repaired as there was some circuit problem. When I asked for a replacement of phone since the said device was under warranty, I was told that it would not be replaced since the damage happened due to water spill. I tried my level best to explain the person concerned that that has never happened but to no avail. Also I was initially told by the manager in-charge of the Delhi service center that the phone has not yet been dispatched from Bangalore but when I insisted on them searching for it, the phone was found to be in the Delhi center itself.

Since my problems were not addressed at the service center, I had to go to the outlet from where it was purchased to seek help on the same. After 3 days, I received my phone back in FULL WORKING CONDITION. It was difficult to digest the fact that a random outlet could have my phone repaired, Albeit temporarily, but the authorized service center could not. It really was baffling.

However after another 2 months the same problem cropped up again and this time I sent it to the same service center in Delhi, But through a colleague of mine since I knew I would be told the same as told to me 2 months back. The phone was again taken for repair and this time I received it back after almost 3 weeks but with the track pad working. The unsolvable problem, apparently, had a solution, although temporary.

I regret to inform that the same problem has again started happening on my phone for the last 1 week and it is a cause of grave concern for me as I cannot access my mails from my phone, which in fact was the main purpose of purchasing this phone in the first place. The phone is still covered under warranty and it has been at the service centers for more time than with me. I am sure you would appreciate the fact that I cannot provide any evidence to support the fact that the spoilage is not due to water spill. The issue is of a faulty device and I am well within my rights to ask for a replacement phone.

This phone has been more of a bane than a boon to me The customer service support for the same has been abysmal and I have been made to run pillar-to-post to get my device repaired but to no avail. I would request the company to provide me with a replacement as the phone is still under the warranty period.

P.S. I am not sure but I guess the company should have personnel checking the websites where consumers regulary post their concerns regarding track-pad malfunctions. I am sure the company would understand that water spill is not the reason for this.
