Improper working of Mobile since purchase

IMEI No.: 356253043242804. Purchased Dt.: 21.5.2011.

Since Purchasing this mobile set, I faced lot of Mental agony through its improper / Inconsistent Function, follow up with Nokia Care & spending on followup. I have not received any calls from Nokia Care when delayed, despite my followup, being a Sr. Citizen & Heart Patient.

Since date of purchase, I faced problems of - Battery not charging properly, consuming Battery Fast even without calls, incoming Audio improper & Outside calls complaining could not hear properly & often getting disconnected. On complaining to the seller, I was suggested to approach Nokia Care mentioning either they will replace or attend minor complaint. With difficulty, I located Nokia Care at Tambaram for my Locality and approached. I was told they are shifting Office & approach after a week. Again I approached Newly shifted Office, who replaced battery mentioned now it will work. It improved for some time & the problems start repeated. Again I approached for two more times, Nokia Care attended, but could not solve problem. Finally they mentioned the mother board is shorted as such it will be sent to their H.O. and I am to wait for a week. After a week, Set was not ready, mentioned everyday they expect the next day it will be delivered. At this stage I mentioned since beginning I faced the problems & the set being sub-standard, it deserves replacement or to return my money& gave it in writing to them. Subsequently, on contacting them it was mentioned that they were issuing a new set as replacement & requested for some more time. I waited further, received intimation asking to collect the set. But, they offered my Old piece with mother board replacement, they have no new set as now the model is withdrawn.

I informed them that I cannot rely on the old set which already has given enough problems despite under warranty and cannot face on model which is withdrawn. I request them to either give me a new set from the existing market which will not give me any further problems / return my money.
