We came across the above Organization (happened to be very close to my residence in T Nagar, Chennai) through a TV program and discussed our requirement and gave a verbal order. Also visited them in an Exhibition in Chennai during December (X-Mas and New year holidays) and gave a token advance of Rs. 70, 000.00 on Jan 02 and booked our order. The advance was given to confirm our order and to get the benefit of an offer of 4 burner gas stove, offered by another manufacturer during the exhibition period.
The time requested to complete the prescribed Job was 3 - 4 weeks. As our Flat (at Chennaipattinam, Tiruporur promoted by CeeDeeYes builders) was about to be made ready by end March we requested Classic Decor to start the project by first week of March and complete it by month end. An additional advance of Rs. One Lakh was given on Feb 02 to procure and fabricate materials at their factory. In their presence we had given a letter to the builder (CDS) to allow Classic personnel and materials into our premises starting March 05. Based on the time period and assurance given by Classic we had planned the "House Warming" ceremony by Mid April but canceled the function a the work was not even started by that time. On April 20th Classic requested an additional amount of one lakh with the assurance that the work will be completed by end April and I can plan the House Warming function on May 01. We had given the One lakh additional fund but only the basic (skeleton) work was initiated an we had to perform the function on May 01 without any progress.
Between April 06 and June 02 we made 'n' number of calls but the calls were invariably unattended. When we tried to call them from different numbers we were replied "that I will call you back in 15 minutes in the same number" but not even a single call was made. We had sent innumerable messages via SMS but not even a single reply was made to any of the messages. The last message on 2nd June that we have decided to proceed legally against him was also did not have any impact.
Apart from not completing the job they started giving wrong information that work is being done at the premises.
We could not meet them in their office as they do not have any regular office timing. Their office will be always closed with lights-on and external shutters open.
As of today the work is in progress at snail pace but we have decided to move into the flat with unfinished kitchen and ward robes as we have committed to vacate the existing rental house.
We would like to claim interest for the advance paid, damages for the phenominal delay in executing the work, for the ill-treatment meted out to us by not replying to any of our calls and messages and for diverting the advance fund (of Rs. 3.70 lakhs) to other projects.
I have saved all the messages sent to Classic and can produce when required.
We need the consumer forum to address the above issue and punish the culprit.
