Dear Sirs,

I am writing this email with deep Grief, Pain & gallon of tears in my eyes, towards an untoward and irrevocable incident - DEATH that happened on 10th. Of August at the above mentioned Super-Specialty Hospital; Also intention of preventing others become a victim as we want stringent & stern action against above “THE MISSION HOSPITAL AND ITS DOCTORS” which is located at DURGAPUR – 12 above mentioned address. Also to make sure that they can not repeat their loot business / and in such gross misconduct in the name of treatment, and towards an untoward and irrevocable incident that happened on 10th.of August at the above so-called (?) super-specialty Hospital – The Mission Hospital: Durgapur – 713212.

Playing with the life of a patient, who was the only earning member of his family (lower middle class) and putting by force him in critical condition only for the purpose of earn more money. That the late Dilip Acharya and his wife, daughter and other relatives herein did not assume the risk of the injuries and death of the late Dilip Acharya.

1. The complaint is regarding an emergency patient – Late Dilip Acharya – MR No: 35905; IP No: 1519 was admitted in the above mentioned Super-Speciality Hospital – The Mission Hospital, Durgapur – 12, on June 05th.2010 at 21.46 night for some discomfort and ailment, we wanted to admit Lt. Dilip Achatya to meet the emergency for that night - He was only required to be kept at hospital and given proper nursing, food, care. and we had planned to move / shift to Kolkta in specific specialty well equipped hospital on next following day, where he can get his proper diagnosis and better treatment for his disease and problem, because The Mission Hospital – Durgapur is not at all equipped the specific & such disease like Lt. Dilip Acharya that he has suffered and ultimately expired there.

2. The wife and relatives requested the hospital authorities as well as Dr. Bose that come what may, even on compassionate grounds to admit in the hospital for regulated Medical treatment and proper management of diet.

3. Accordingly, on the next following day, we approached to the Authority of the Mission Hospital TO SHIFT the patient to Kolkata or Vellore, CMC for BETTER TREATMENT, but Dr. Satyajeet Bose, Chairman refused & denied and said that they don’t have any Corporate Policy to shift or transfer to other Hospital. Accordingly we have asked him to provide us in detail their so-called “Corporate Policy”, but they have not able to provide us the same in spite of several reminders and totally failed to meet us.

4. The unfair Doctor Satyajeet Bose, Chairman especially when the situation was so crucial / critical and there Doctor did nothing except to put him to ICU, but no treatment or any equipment was used only for the purpose of ill- motive to snatch money from the patient.

5. The more poignant statement was when they relay us patient status wrongly. There was nothing intensive about the care and we look forward to transfer / referred to other Hospital at Kolkata and the Doctors Satyajeet Bose, and Dr. S.K. Shukla both they never allowed and mis-leaded us for surgical interference (SHUNT) and other necessary operation and committed with an assurance for complete cure, though they don’t have any full fledged and well equipped in neuro – surgery not only that Dr. Shukla’s expertise is on main question for such critical operation. Dr. Satyajeet Bose is Very unprofessional, he will rip you off and they will lie in to your face only for the purpose of bad motive and his gathering experience by such guinea pig operation. The hospital authorities were even not to give discharge or referred or transferred, as we felt there and ultimately Dr. Surojeet Bose killed the patient in own vested interest.

6. Dr. Satyajeet Bose is not all a Doctor of Neuro – medicine or surgery, but he looked upon & after the patient Lt Dilip Achatya, because there is no pay roll or full time Doctor of Neuro Section nor well equipped for the Neuro patients or surgery, but they forcibly done this Operation only for their vested interest and ultimately killed the patient.

7. Late Dilip Acharya was a patient of Brain Tumor and the that was operated at CMC, Vellore at about 12 years back: post operated case of “VENTRICULO – PERITONEA”” and was quite good and performed & leaded his normal life as well as his employment in regular manner till June 05th. 2010. During this period he was under only routine check-up under Vellore, CMC Hospital.

8. Late Dilip Acharya was taken to the above mentioned Super specialty Hospital with the symptom of some dis-comfortness, headache at 10:30 PM and reported to the emergency for immediate care & necessary treatment.

9. We expected a much higher level of treatment from the Hospital; Late Dilip Acharya was admitted there more than 75 days recently where he was diagnosed with “SEPTICAEMIA”. However, his condition deteriorated, the doctors did various tests on him and took scans of his brain where they eventually found the cause of his deteriorating condition, why such a piece of state-of-the-art equipment was not used, though we understand that the Hospital have not equipment in Lt. Dilip’s disease., and expired on August 10th.2010 at 08.10 morning.

10.Dr. Satyajeet Bose Chairman of that above said Hospital was negligent in his care and treatment of Mr. Dilip Acharya in that he failed to care for and treat him in accordance with the standard of care and skill required of, and ordinarily exercised by the average qualified physician engaged in medical practice at the professional level.

11.This letter is to complaint about the treatment, diagnosis and the care given recently we received from the Mission Hospital-Durgapur and the Doctor – Satyajeet Bose, Chairman of the Super Specialty in nature - Hospital. Needless to say, we were victimized; quite frustrated; that he failed to care for and treat him in accordance with the standard of care and skill required of, and ordinarily exercised by the average qualified physician engaged in medical practice at the professional level.

12. Why the the authority of Hospital were KEEN INTERESTED ABOUT OPERATION? IT IS CRYSTAL CLEAR THAT THEY INTENTIONALLY THOUGHT OUT A PLAN TO TRAP us. HOW THEY CAN PLAY WITH THE LIFE OF Lt. DILIP ACHARYA.

13. As a direct and proximate result of the inefficiency / negligence of Dr. Satyajeet Bose, Mr. Dilip Acharya has suffered injuries and damages for unnecessary surgical procedures / interferences, pain and suffering, financial loss, and other damages which rendered him no longer able to engage in his chosen profession.

14. A so-called Hi-Tech Super-specialty Hospital (?) but No System, no Policies, no QMS or any other accreditation nor having any system of Web facilities (though there a deactivated web; which is like a toy for eye wash) or any other system there except to upland and to snatch dune of heap money by holding out patient on threats, creating unnecessary panic to the patient and their relatives by way of wrong treatment / mislead / misguide and also not required treatment.

15. I am quite sure how much detail I should reveal because rehashing this experience was so upsetting for our family. It is firmly stating that there was little to no communication between the doctors/nurses and our family.

16. Assurance and operation which such a professional can give or can be understood to have given by implication is that he is possessed, of the requisite skill in that branch of profession which he is practicing and while undertaking the performance of the task entrusted to him he would be exercising his skill with reasonable competence.

17. That on August 10, and thereafter, the Chairman Dr. Satyajeet Bose, by and through their visiting Doctors/employees/agents breached the applicable standard of medical care owed to the late Dilip Acharya, which directly caused a physical injury to the patient and was the direct and proximate cause of all of the injuries and damages being pursed by the relatives of late Dilip Acharya..

18. The Authority of the Mission Hospital of Durgapur - 12 and the Head: Dr. Satyajeet Bose must understand to his task a reasonable degree of skill and knowledge, and must exercise a reasonable degree of care.

19. That the death of the late Dilip Acharya on August 10, was directly and proximate caused by the negligent, inefficient actions of Dr. Surojeet Bose / Dr. S.K.Shukla.

20. That Late Dilip Acharya, the surviving spouse and the daughter of the late Dilip Acharya, sustained pecuniary loss, mental anguish, emotional pain and suffering and other damages arising out of the death of Dilip Acharya.

21. It was abundantly made clear to the Hospital Authority and Doctor Satyajeet Bose and his team who had treated the deceased that the disease was of such a nature and had attained such gravity, nevertheless, the patient was not treated with utmost care and caution and given all the required medical assistance by the doctors and para-medical staff.

22. The wife and his relations, who were misguided or were under mistaken belief as to the facts - wholly unwarranted and uncalled for only for the whims of Dr. Satyajeet Bose, Chairman.

23. It is transpired that when such an act is in itself innocent, to punish the person who does it because bad consequences, which no human wisdom could have foreseen, have followed from it, would be in the highest degree barbarous and absurd.

24. To punish as a murderer the Hospital Authority and Dr. Satyajeet Bose, the Head who committed a heinous offence, causes death by pure misadventure for the security of human life.

25. That the acts of medical malpractice occasioned by Dr. Satyajeet Bose, Chairman that proximately resulted in the death of late Dilip Acharya, occurred on August 10.

26. That the standard of medical care applicable to Dr Satyajeet Bose, Chairman was to provide the proper medical follow-up care for the late Dilip Acharya (also referred to herein as “the patient”) following a surgical procedure which included: taking proper care of the tubes inserted into the body of the late Dilip Acharya to insure that the tubes were functioning properly.

27. It also has also been observed as determinative of mislead, misguide & negligence in professional, a medical practitioner was to be held liable simply because things went wrong 0r from mischance. Negligence of any professionals such as lawyers, doctors, architects and others are included in the category of persons professing some special skill or skilled persons generally.

28. Any task which is required to be performed with a special skill would generally be admitted or undertaken to be performed only if the person possesses the requisite skill for performing that task.

29. Any reasonable man entering into a profession which requires a particular level of learning to be called a professional of that branch, impliedly assures the person dealing with him that the skill which he professes to possess shall be exercised and exercised with reasonable degree of care and caution.

30. But, it appears from his attitude that he is very influential person and directly related to the local important persons in Government and politicians.

31. Dr. Satyajeet Bose, the Chairman of the Mission Hospital should be unlicensed, for his committed gross ignorance, or gross inattention, or gross rashness, in his treatment, he is criminally responsible.

32. Culpability & in Capability is attached to the consequence of an error in circumstances where substandard antecedent conduct has been deliberate, and has contributed to the generation of the error or to its outcome.

33. Dr. Satyajeet Bose, the Chairman of the Mission Hospital should be unlicensed, for his committed gross ignorance, or gross inattention, or gross rashness, in his treatment, he is criminally responsible.

34. Culpability & Capability is attached to the consequence of an error in circumstances where substandard antecedent conduct has been deliberate, and has contributed to the generation of the error or to its outcome.

35. That this Hospital is specialized only one or two medical section or departs, but not for all types of patients, as well as not medically well equipped except one or two

36. That the Hospital is equipped with ICU with a very normal Instruments & equipments, and Doctors are only available hired, visiting local Doctors on call basis or as per their requirement and to meet the patient but not for full time.

37. That here, the Hospital Super Specialty is a hoaxing and deceiving to the persons and the areas; only an exorbitant extortioner/vampire.

38. That, If anybody be affected with sudden dizziness or faint or nausea / retching, the Doctor Satyajeet Bose, the Chairman, who is a necrophagaos evil spirit and nauseating nature holding out them threats on inception commencement; because he awfully mighty or vigorous. And his main attraction / object to fetch / snatch a dune / upland heap of money not the treatment or correct diagnosis of the patient for relief.

39. That, If anybody be affected with sudden dizziness or faint or nausea / retching, the Doctor Satyajeet Bose, the Chairman, who is a necrophagaos evil spirit and nauseating nature holding out them threats on inception commencement; because he awfully mighty or vigorous. And his main attraction / object to fetch / snatch a dune / upland heap of money not the treatment or correct diagnosis of the patient for relief.

40. That the main practice / business is that: Don’t’ bother about the Patient:-

i. That they will admit all patients, whether they are able to diagnosis or not

ii. That the conversation/dealings/behavior are very harsh / non sympathetic to the patient and their relatives.

iii. Only money is required but not for the treatment or referred / forward to the other hospital.

iv. Mortuary is just on the main gate of a school, and no infrastructure is maintained. Temperature controller is just a toy, showing a temp. 6 degree with open windows and a high room temperature.

v. Mislead / misguide/ wrong diagnosis are the main expertise.

41.Patient cure/ recovered rate is nothing but remarkably death rate is so high and recorded in the burning ghat – electric furnace is one patient in per hour

42. That Oath during his professional registration is base less to him, because he purely is tendon to a scabbard in nature by forgetting his noble profession to the mankind and humanity as well as society.

43. He do not / never consecrate his life to the service / laws of humanity, respect for human life from the time of conception or do not practice profession with conscience and dignity. The healths of patient will not at all his consideration, also do not the honor and noble traditions of medical profession.

44. He never abides by the code of medical ethics as enunciated in the Indian Medical Council (Professional Conduct, Etiquette and Ethics) Regulations 2002.

45. I would like you to investigate these matters and I look forward to your early response and in this regard, I would like the following action to be taken; as a rare and examplanery punishment to the mankind & Society:-

i. Investigation of the entire facts, as explained above.

ii. Hospital should be unlicensed immediately,

iii. Cancellation of Dr. Surojeet Bose’s professional registration,

iv. Necessary disciplinary action against Dr. Surojeet Bose, Chairman,

v. Refund of entire bill amount and its related compensation to the family as he (lt. Dilip) deceased patient was the only earning member.

The punishment of Dr. Satyajeet Bose, Chairman and the malpractice and ill motive activities of the Mission Hospital and its Authority - Durgapur should be ventilated / published widely in all Electronic Media as a teaching of others, who does this type of malpractice to the Patient and humanity.
