MISBEHAVIOR AND DAMAGES

Dear Sir,

LODGING OF COMPLAINT AGAINST ATRIA MALL

CONSUMER PROTECTION ACT / MRTP COMMISSION REDRESSAL OF GRIEVANCES

1. I am Defence officer posted as DIRECTOR (NAVAL WORKS) in HQCE (NAVY) at DEFENCE STATION COLABA MUMBAI.

2. I reached ATRIA MALL WORLI MUMBAI on 27 December at 1pm with my family to watch ORAMA 4D show from Navy Nagar Colaba Mumbai.

3. I was intimated at the ticket window that tickets are available for show of 5pm screen no. 1 and all tickets for 3pm show are sold out.

4. I purchased Four tickets of Rs680/- and waited for 5pm show and when we tried to enter the screen no.1 at 4:55pm we were informed that this complete show of 5pm has been booked for some private party after our purchase of tickets, so we will be allowed to watch the show only after this show is over and complete.

5. We again waited for about 20 minutes after 5pm and approached Screen no.1 and we were informed that screening of show is totally uncertain. So we were asked to return the tickets and Rs 680/- were refunded at 5:30 pm.

6. We went to parking place B-2 to pick our car and go back to Navy Nagar Colaba Mumbai. To our utter disappointment parking staff wearing green uniform misguided us and our brand new car Toyota Etios which was purchased on 12 December got severely damaged.

7. The matter was reported to the staff available with under mentioned details but no action was taken.

i. Sh. Salman Umar Sheikh CPS Parking on duty was not having any I/D proof Parking/Security and he misbehaved with us and did not respond despite of our requests.

ii. Mr. Katak senior of Sh. Salman Sheikh was not available and did not respond despite our best efforts.

iii. Mr. Sumit Verma property manager was requested to resolve the issue, he too was not available at that time.

iv. Parking ticket no. 346011 with central parking services issued to us was not taken/seen at the time of exit from parking and parking ticket is still in possession with us as a proof of happenings.

v. We all the family was harassed at ATRIA mall.

vi. The car was taken to Shinrai Toyota AT 6:15 PM for assessing the damage and repair cost has been assessed as Rs 8000 to 9000/- with 4-5 days of repair.

vii. The complete case was again narrated on telephone no. 24813333 to Sh. Sachin, security supervisor at 9:45pm and it was assured that case will be resolved and damages will be redressed with the intervention of Mr. Nilesh.

8. No action has been taken by ATRIA MALL to redress our genuine grievances and as a consumer we have no other option but to claim our damages and approach consumer court/ MRTP commission/Police to seek redressal of our genuine grievances on account of

i. Non screening of show of 5pm despite of purchase of tickets and booking the show for some other party. Thus visiting ATRIA Mall all the way from Navy Nagar Colaba to Borivali has gone totally waste.

ii. Severe damage to car due to gross negligence of Parking/Security Staff.

iii. Harassment and misbehavior to all family members by parking and security staff.

iv. No response from staff of ATRIA MALL despite of all the efforts.

v. Wastage of precious time and complete day without any result.

9. An immediate action is required to be taken to adequately and suitably compensate for the damages suffered by us as per THE CONTENTS MENTIONED above.

1 IT may be treated as FINAL NOTICE for lodging a formal complaint.
