Instrument not at all satisfactory from the day one

I bought Black Berry Bold on 29.07.2009 with the intention to be more comfortable with it but from the day one I feel cheated by having this instrument. Initially I thought that I am a new user to it therefore I tried all the best to make out the actual problem. I lodged complaint with Blackberry service station at South Extn. on 31-08 vide their complaint No.22412456 for the following undermentioned defects.

1. It starts Self Scanning any time due to which the the connection is switched off for several hours till

we insert charger pin.

2. It switches off automatically.

3. Problem of software hanging.

4. Automatic deletion of date.

It was assured to me that the set will be replaced with new set very shortly. The service centre staff calls me to deliver the set but whenever I visit on that date they simply answer that the have not received the same from Company. I have spended Rs.28, 500/- for my comfort and not for nuisance. I request either they replace my set or refund my amount immediately. If still no decision is taken I will file suit with damages at the cost of BlackBerry.
