I bought jewellery from ebay online

I bought this item on 17th July. The Seller did not ship the material, when the system automatically went to refund status, the seller called and requested me to cancel the Refund, so he could ship the material. In good faith, i did the same. this was done on 25th of Jul'09. I have been contacting the ebay team and I was informed that I can log a claim only after a month. The claim was logged on 17th Aug'09. I have called on the toll free number and spoken to the ebay executives and Managers Mohini, Jyoti and Pranay. They have been making fake promises and never call me back.
Darren from claims keep writing absurd email and giving me dates after dates and in his last email he said they will get back to me by 26th Sept and i have not heard from them till now. On 28th, when I called ebay and spoke to Pranay, he promised a reply in 24 hours and when I called today after 48 hours he refused to take my call and the executive Phani said he will call me in 20 mins that was at 1:20 IST. I have not heard or receieved any calls or email response.
I would like to understand why it should take 30 days to claim and another more than 30 days to resolve with the seller. when the seller has not shipped the material and I have paid for it, what is taking so long to resolve the refund.
I would like to lodge a complain and appreciate if severe action is taken.
