Haier c2030
Not changing the battery

I have bought haier mobile model no c2030 from ludhiana in which i am using ping sim after one week the set is not charging i went to service center they said that battery is defected but they refused to change because they said that you are using ping no, not tata no. what should i do know please help me should i file case against them in cousumer court.
