This is to inform you that in or about the 1st week of March, your representative approached us stating that you are dealing in computer systems and that your computers have got greater value and good reputations in the market field. Based on the aforesaid representations made by your representative to be true and bonafide, we placed orders for purchase of 120 computers. Based on the offer made by us, you issued a quotation dated 3.3.2009 wherein you have agreed to supply the computers as required by us, at the rate of Rs.14, 800/- per systems and as per the terms and conditions, you have further stated that an initial sum of Rs.25% to be paid by us by way of D.D. and the balance consideration to be paid against delivery of the systems in all respects as required by us.
In the quotation dated 3.3. you have specifically agreed to deliver the computers as required by us immediately. Based the quotation, we had paid a sum of’ Rs.1, 00, 000/- on 2.6.2009 and the further payment of Rs.3, 00, 000/- on 3.7.2009 with the fond hope that you will supply the computers as required by us at the earliest. It is not out of place to mention here that we wanted the aforesaid computers for the purpose of providing the same to our students who are in dire need of the same. In spite of payment of a huge sum of Rs.4, 00, 000/- as stated above, you have miserably failed and neglected to deliver the aforesaid computers to us for the reasons best known to yourselves. We have been contacting you time and again and though you have been assuring us that you will deliver the computers to us shortly. You have not kept up your promise of delivery of the computers, with the result we are put to untold sufferings, hardship and mental agony. It is needless to stated that we have already paid a sum of Rs.4, 00, 000/- and the purpose of which such a huge sum has been parted with has been completely shattered on account of the gross negligence, deficiency in service and unfair trade practice committed by you.
As we had an urgent need of computers for our academic purpose we were forced to avail the supply from other dealers who immediately responded and supplied the same.
Due to your mere negligence and deficiency in service we are now forced to cancel our order and return the advance amount along with interest. If there is any default in payment we will be forced to enter into the Legal Cell.
