Non-delivery of Hyundai i10 after 32 days

Dear Sir,

I had booked a Hyundai i10 Sportz Automatic model with dealer A1 Auto Pvt. Ltd, 3/4/5, Town Center, Andheri-Kurla Road, Sakinaka, Andher (E), Mumbai – 400059.

1. I had booked the vehicle on 14th March. I was promised the delivery of the vehicle on 27th March through salesperson Mr. Naveen Prithani.

2. On 23rd March I made the full payment of the vehicle since I was told that vehicle has left Chennai Plan of Hyundai.

3. On 25th March Mr. Naveen come to my office and said he wanted to meet me due to a small problem. He then apologies and updated that by mistake the manual version of the vehicle had got ordered. Due to this he was not in a position to deliver as promised since the incorrect vehicle has landed with him. Thinking this to be a genuine human mistake I accepted his request.

4. Mr. Naveen then confirmed on 26th March that the new order had been placed and promised me a new delivery date of 7th April. Till 3rd April I kept calling regularly and was given updates that vehicle is in process.

5. On 6th April I went to the showroom to get an update on my vehicle delivery which was due the next day. Shockingly I was informed that Mr. Naveen had been sacked due to making promises to many customer which they could not fulfill. More socking than that was the news that my car was delayed. I then met the Sr. Manager of A1 Auto Mr. Jude Tandon. He promised me that the car will be delivered to me on 13th April.

6. Since I had already had too many promised broken I lodged a formal complaint with Hyundai on 8th April via mail. Copy of mail attached below:

I would like to lodge a formal compliant against your Mumbai dealer A1 Auto located at Andheri (E), Sakinaka. The dealer while following up for the order made all sorts of promises and once the booking was formalised then changed his stance.

1. The delivery was promised for 27th of March. The entire booking amount was collected in 2 parts before hand itself. The first booking was made on 15th March were a cheque of Rs 50, 000/- and full payment made on 25th March. A few days prior to the promised delivery date the sales consultant (Mr. Naveen Prithani) calls and says wants to meet. He then meets up and informs that there is a small mistake and that he has incorrectly placed the order for manual version of i10 in place of the Automatic Sportz model ordered. He pleads to be given extra time and commits to give some extra accessories as a compensation.

2. Again 2 days before the new delivery date of 7th he says there will be delay due to holidays. Also, he now asks for copies of registration book and insurance papers of old car. These where never discussed earlier.

3. Against the promised free accessories the sales consultant starts asking for 50% value. He also starts dropping items from the commited list of accessories.

I would like to highlight the pain and mental stree caused due to these problems faced with the dealer. Despite escalations only promises are made.

Request you to pls look into this and advise if as a consumer you have any mechanism of redressal of my plight or method of penalising your dealers.

Would request you to pls acknowledge the recipt of this mail.

7. I received email response saying someone would contact me within 3 days. The next day I was given a complaint no on SMS which is 1-19576035. Then I got a mail asking for more details which I promptly provided. But till date no one has contacted me from Hyundai.

8. I then called up one Western Regional office no which was listed. After 2 days of trying I got throught to someone who provided me with the name of Mr. Deepak Raina who I was told is the Area Sales Manager for Andheri area. I tried on 10th but he was not available. On 11th April he picked up the phone and said was in meeting. Then till Monday 13th April his mobile was switched off.

9. On 12th April I then decided to visit the the dealer to check if the promise made by Mr. Jude of 13th April was being met and see if my car was going to be delivered. I got another shock to be told that car has still not come in. Mr. Jude was himself on leave and his people didn’t have a clue about my car. After a lot of drama and discussion they decided to check the inventory. Then came back to say that the car had come but registration was pending. Mr. Sumedh Kulkarni, a new salesperson, then committed to deliver my vehicle on 15th April by expediting the regitration.

10. Since Mr. Sumedh confirmed that he was new to the dealer organization I decided to pursue my complaint with Mr. Deepak. On 13th when I finally managed to speak to him in the evening he gave me his email id and asked me to forward my complaint mail. I prompt send him the email.

11. On 14th April again he would not pickup my calls. I then sent him a reminder mail. But he did not revert back.

12. On 14th April itself in the afternoon I received a call from A1 Auto saying my car will now be delivered on 18th April only as registration would take time. I wrote this on mail to Mr. Deepak. Mail copy attached below.

A few minutes back I got a call from Ms. Shaila Mane from A1 Hyundai Andheri saying I had put a compliant about delayed delivery. She then updated me that the car has landed on 9th and will go for registration tomm. So my car will now be delivered on Saturday 18th April.

This is indeed another big surprise. Yesterday when I spoke to Mr. Sumedh Kulkarni he informed me that PDI has been completed and he will be able to get the car ready by tomm 15th Wed after all registration formalities.

So I am again at a loss if my escalations are at all being taken seriously by Hyundai or I am being left at the mercy of the dealer to continue playing with me as I have no support from Hyundai.

I am still to hear form you about any action that you may have taken or planned to take on my case.

In case I don't hear from you pls rest assured that I will take this up in a consumer court and ensure that it is also published in the press as well.

13. On 15th April, I finally decided to escalate the matter to India head of Hyundai. After a lot of struggle I managed to get an email id and send out the below mail. It is shocking to note that no action has been taken on my case even my the India head.

I would like to bring to your kind attention the high handedness of your dealer (A1 Auto Pvt Ltd., Andheri (E), Sakinaka) and Hyundai Area Manager (Mr. Deepak Raina) in attending to a complaint which I have lodged on 8th April. Just to give you a brief background :

1. I had booked my vehicle on 15th March. I was promised delivery on 27th March. Till date I have not yet got delivery but only new promises every day.

2. I have lodged a written complaint with Hyundai on 8th March and sent several mails after that. Till date no one has contacted me back with status of my complaint.

3. Yesterday I called the Hyundai call center. They were not able to help at all. They promised to revert in 2 hours. But I am still waiting.

4. I have repeatedly called Mr. Deepak Raina, your local Mumbai Area Sales Manager. His cell is either switched off or not reachable. Once he picked it up to say he was in a meeting and then the cell was off for 2 days. I managed to get him finally and he asked me to forward the mail complaint. After that I am yet to hear from him again or see any action.

5. As detailed in my below mail I got a call from the dealer again giving me a new date and new story. So am not sure of what my fate is.

I would humbly request you to kindly help in cancelling my booking and beg of you to relieve me of my pain by returning me my full booking amount. If this is the support at the start of the relationship with Hyundai then I shudder to think what would be the fate going forward.

14. After all these false promise, mail, escalations, call, etc I am still without my veichle even today on 17th April even after more than a month of booking my car. I shudder to think what other consumer would be facing with dealers like A1 Auto and at the same time the shabby compliant support of Hyundai. At this stage if someone were to offer me a FREE Hyundai vehicle I would not want to even look at the same.

I would like to earnestly request you to please tale up my case with Hyundai and ensure there is some mechanism put in place for punishing corporate like Hyundai.
