NON ISSUE OF DUPLICATE NSC/KVP

Dear Sir,

SUB: LOSS OF KVP / NSC ; REQUEST FOR ISSUE OF DUPLICATES ; NON RECEIPT TILL DATE.

I had purchased Kisan Vikas Patras and National Saving Certificate in the name of myself (Janak Raj Goyal) and my wife (Suman Goyal). The details are given in the attached ANNEXURE – A.

I purchased these certificates from Sub Post Master, Kothavalasa Post Office, District Vizianagaram (AP), PIN 535183 while I was serving in Jindal Strips Limited and residing at Jindal Nagar, Kothavalasa, District Vizianagaram (AP).

I changed my job and shifted to Delhi in the month of June and have been residing at House NO 133, Sector 14, Faridabad 121007 (Haryana) which is my present permanent and postal address.

On 26th February, I lost my brief case containing these Certificates with some other documents and bonds. I filed FIR with Hauz Khas Police Station, Delhi on 27th February at 12.00 Noon vide report No. 11/02.

I applied to Post Office, Kothavalasa, District Vizianagaram for Issue of Duplicate Certificate through my friend and surety Mr M Srinivas who was resident of Jindal Nagar, Kothavalasa, District Vizianagaram. All the required documents as detailed below were filed on 7th May and duly acknowledged by Sub Post Master, Kothavala Post Office :

1. Application for Issue of Duplicate Certificate in the formant given in Annexure – 1.

2. Bond of Indemnity in the format given in Annexure – 2

3. Report on application for duplicate certificate from Sub Post Master, Kothavalasa.

4. Copy of FIR

5. Salary Certificate of Surety, Mr M Srinivas.

6. Payment receipt of Fees for Issue of Duplicate Certificates.

I understand that Sub Post Master, Kothavalasa had forwarded all the documents to the Post Master, Vizianagaram (as I got a copy of letter written by Post Master, Vizianagaram to Sub Post Master, Kothavalasa ; No. NSC Counter/-05-06/ dt. 7.11.2005)

In the aforesaid letter, Sub Post Master, Kothavalasa had asked for the following information which were not required at all and seems to be some tactics to delay the issue of duplicate certificate for reasons best know to the concerned officer, may be for some mala fide intentions. The queries raised by the Post Master, Vizianagaram and my responses are given below:

a. Pay certificate (recent) and Police Certificate original should be enclosed.

The Pay Certificate of surety was filed at the time of filing of application. If there is any delay on the part of concerned post office, it should not and can not ask for the pay certificate as on the date the Post Master feels like. It is quite mala fide. Similarly, Post Master seems to be quite ignorant of his duties and rights of certificate holders and his normal legal rights. He has no right to ask for original copy of FIR. He can only ask for self certified copy, which was filed along with the application. He should well know that I was issued only one copy of original FIR, and how could I submit the original to various authorities.

b. Identification Signatures not taken from a person know to Post Office at the place provided for in the application.

I really don’t know what does it mean. Surety had signed all the relevant documents including application form. He had submitted copy of his salary certificate to Sub Post Master, Kothavalasa which is a proof of Identification. I don’t know how could I depute someone who is known to the concerned Post Master. Is it my duty to find such a person or the duty of concerned Post Master to take Identification Signatures. If concerned Post Master is at fault, why should I be punished for that.

c. Application fees of Rs.10/- was not collected in case of Suman Goyal.

This query seems to be quite funny. It was duty of concerned Post Master to collect relevant fees at the time of accepting application. HOW COULD MY PAYMENT OF RS, 150000/- (APPROX. MATURITY VALUE OF ALL CERTIFICATES) BE STOPPED FOR JUST RS.10/- AND THAT TOO WHEN I AM NOT AT FAULT. MOREOVER, WHY ARE OTHER CERTIFICATES NOT BEEN ISSUED WHERE REQUIRED FEES IS PAID. POST MASTER COULD HAVE COLLECTED THE FEES AT THE TIME OF ISSUE OF DUPLICATE CERITIFICATES. WHY AM I BEING PUNISHED FOR THE IGNORANCE OR MALA FIDE INTENTION OF CONCERNED POST MASTER.

Though I applied for Issue of duplicate Certificates way back in the month of May (more than 5 years back) and pursued the matter with the Post Office Kothavalasa and Post Master, Vizianagaram, the duplicate certificates have not yet been issued.

In the mean time all the certificates have matured and payments become due.

MAY I NOW REQUEST AS BELOW:

1. AS THE CERTIFICATES HAVE ALREADY MATURED, ACCOUNT PAYEE CHEQUES / DRAFTS MAYB BE ISSUED BY THE CONCERED POST OFFICES IN THE NAME OF RESPECTIVE HOLDER AND SEND TO MY CURRENT ADDRESS (GIVEN IN THE DOCUMENTS FILED INCLUDING COPY OF FIR).

2. ANY SHORTFALL OF FEES IF ANY MAY PLEASE BE DEDUCTED FROM THE AFORESAID AMOUNT.

3. AS I APPLIED FOR ISSUE OF DUPLICATED WELL BEFORE THE DATE OF MATURITY AND DELAY IN ISSUING IS ENTIRELY ON THE PARST OF CONCERNED POST OFFICES, I SHOULD BE PAID INTERESTED UPTO THE DATE OF PAYMENT.

4. PLEASE EXPLAIN TO ME WHY SHOULD THE CONCERED POST MASTERS BE NOT ASKED TO EXPLAIN THE REASONS OF DELAY AND BE PUNISHED FOR POOR SERVICES AND MALA FIDE INENTIONS.

5. WHEN I GOT DUPLICATE BONDS FROM ICICI BANK (WHICH GOT MISPLACED SIMULTANEOUSLY) ISSUED WITHIN A 15 DAYS TIME, WHY HAS IT TAKEN MORE THAN 5 YEARS AND STILL I AM WAITING FOR DUPLICATES BE ISSUED TO ME.

THIS IS WITHOUT PREJUDICE TO MY RIGHT TO TAKE ANY OTHER ACTION PERMISSIBLE UNDER THE LAWS OF LAND OF INDIA.
