On 25th of August, myself and my friend Ms. Salimol went to a Kid’s Store “Jesania Inch” which is located at the Thammanam Pullepadi Road, near St. Jude Church, Kochi-682032 to purchase some birthday gift for her neighbour’s daughter’s 2nd birthday. We bought a Baby Frock (Cost=Rs 385), a Birthday Candle (Cost=Rs12) and a Doll worth Rs199. The total bill amount was Rs 596/- including vat and cess.
While looking through the collection of the baby frocks we found the above mentioned frock to be appealing but expressed out concern that the frock might not suite the kid since the kid was a little plump in nature. The sales man Mr Saddique assured us that if the dress material did not suit the kid, we could bring it back to the shop and he would do the needful. Please take note that we purchased the item only because the sales person assured us that he would do the needful if the dress material did not fit the kid. So while packing the material, we insisted that price tags need not be removed.
As suspected by us, the frock we purchased was very tight fitting for the kid to wear and hence we approached the Shop on the 26th of August at 7 pm for a replacement of the item with the next size. The size we purchased was 20 and hence we asked for the next bigger size i.e. size 22. They didn’t have the same item of the bigger size and hence they asked us to select a different one. After going through all the stock on display, we could not find one to our appeal and hence demanded a refund. Please note that the Frock we had purchased was already taken back by the staff of Jesania Inch and was not returned.
Upon asking for the refund, one of the sales ladies told us that it is their practice that they won’t refund any items purchased from them and that we should purchase any other item from them for the same amount. We told them that we are ok with the next size of the same frock but did not find one attractive enough to replace. So we again demanded a refund and they made us wait for almost an hour and made many telephone calls to their managers and also made me talk to them. In between I overheard them say that it was local Bombay item and hence they could not get a bigger sized one. I wondered how they could charge so much for a non branded local Bombay item. I told them that I am not convinced with any of the collection they had and that Mr. Saddique had promised to do the needful if this frock does not suit the kid. At last they called the owner and the lady at the counter informed me that he straight away denied a refund and they cannot do anything as it was the previous day’s bill and the sales tax is already paid for the sale. She added that they are only the staff and it is the owner’s decision and they cannot help. I asked them to deduct whatever sales tax they have paid and issue me the cost of the item. They refused. So I asked them to write it on the reverse of the same bill that they have collected the dress material from us and cannot give a refund. I told them that the nothing is mentioned on the bill that they won’t provide a refund or replacement for items purchased. The lady refused to help and we had to leave the shop feeling utmost insulted. We had been a regular customer to that shop and had previously purchased a lot of items from them on different occasions. Please go through the below mentioned details as well
