I had come to know by the different advertisements/circulars published by Builder namely M/s. Green City Buildtech Ltd Group is a benchmark in the Real Estate Industry with Word Class Townships, Housing Complexes, and so on……..” in different News papers for purchasing /investing the money for the land at NRI City, Bhiwadi.

M/s. Green City Buildtech Ltd, had signed an agreement with a agent namely M/s. Bahri Estates Pvt. Ltd., having their office at K-7/31, Basement, DLF City-II, Gurgaon-122002 vide their letter/agreement no. NIL dated 15.10. who had introduced me with Real State Industry namely M/s. Green City Buildtech Ltd for the allotment of a plot measuring 200 Sq. Yards in NRI City, Bhiwadi @ Rs. 4100/- per Sq. Yard (Rupees Four Thousand One Hundred only).

I through the above said agent, had booked for allotment of a plot measuring 200 Sq. Yards in NRI City, Bhiwadi and made the down/booking payment on 27.10.2006 vide issued receipt of M/s. Green City Buildtech Ltd, bearing no. 1934/Bahri Estates dated 27.10. through cheque no. 831313 dated 26.10.2006 for a sum of Rs.2, 00, 000/- (Rupees Two Lac) payable at Standard Chartered Bank, Connought Place, New Delhi, on the terms and conditions that the actual, physical and peaceful possession shall be given within a period of Nine Months from the date of payment of booking amount and efflux of time the due date for the possession of the above promised plot at the defined/promised site/area expired on July’07.

I, thereafter, had received a letter no. 1934/Bahri ESTATES PVT. LTD. Dated 09.03.2007 from part of Builder for recovery of First Installment @ discount of 5% in the name of “HOLI BONANZA”, without giving any physical possession to me within the stipulated time of nine months, even after payment of full booking amount by me. It is also relevant to mention here that as and when I had called at the office of agent or builder, to know the status of the possession of the plot, every time, they, both Builder and Agent had pretended that “due to delay in getting the license from the Government”, they are not able to give the physical possession of the said plot and they further promised to give the same shortly.

I had also received an another letter no. 1934/Bahri ESTATES PVT. LTD. dated 17.10. in which M/s. Green City Buildtech Ltd had accepted that there was a land measuring 6800000 sq. yards have been acquired for NRI City, Bhiwadi, meant to distributing to those persons, who had made the payment of booking amount, with apology for the postponement of launching the project of the Builder, due to delay in getting the license from the Government. M/s. Green City Buildtech Ltd further had tried to dupe me by offering “Luxury Flat” at Solitaire Heights Panipat by depositing 10% BSP and balance after the possession.

I also called to Mr. Ashish Bajpai on 13.01. one of the employee of M/s. Green City Buildtech Ltd, regarding the possession on receiving of the above said letter, who also assured that within a period of two months, I shall be able to get the actual, physical possession positively, and vide letter of Builder, bearing no. NIL dated 01.03.2008 titled “Offer of Allotment”, was received at the part of me, but the physical possession is still in dispute. Thereafter, an another letter dated 03.11.2008 was received for extorting money i.e. 25% of total balance amount, without stating as and when M/s. Green City Buildtech Ltd shall be able to give the actual possession.

An another letter no. 1934/Bahri ESTATES PVT LTD. dated 10.03.2009 was received from M/s. Green City Buildtech Ltd at the part to me, in which M/s. Green City Buildtech Ltd has pretended number of false excuses for delaying and also assured that project shall be launched 100% and M/s. Green City Buildtech Ltd have also reduced the rate of per sq. yard from Rs. 4100/- to Rs. 2500/-.

I further reminded to M/s. Green City Buildtech Ltd that I had sent you a letter No. NIL dated 18.06. for actual physical and lawful possession for a plot booked at NRI City, Bhiwadi, at the address of cooperate office of M/s. Green City Buildtech Ltd, which was duly served as well as received by M/s. Green City Buildtech Ltd, but the Builder has not only taken the issue seriously but even the Builder had not made any reply of the said letter to me. Thereafter I had sent a mail dated 17.06. which was also delivered at Builder’s cooperate office, but not any response is received till date from that side.

I had also visited at Builder’s office, in number of time, to know the status of my allotment, but nobody entertained me. I had made number of calls to contact any person at the office of M/s. Green City Buildtech Ltd as well as at the office of Agent, but each and every time, I got disappointments either by the responses or disconnecting the phones by the persons/staff of their respective offices.

I am frustrated upto such extend that I was compelled to start the legal proceeding against those fraud Builder and his agent, who are misappropriating the money of public, and in compliance of same I also consulted to Legal Advisor and issued the Legal Notices also, but the notices, which were issued to both Builder as well as Agent, returned unserved as both had closed their respective office and fleed from there.

Now, I have only faith in Government, to bring both Builder as well as Agent before the Court, by which the investors may get their money back or may get the actual possession of plot as per agreements of Builder and Dealer.
