Instrument not returned

I had purchased Nokia 2865 from StarMobitel Pvt Ltd, New Delhi.

The instrument did not work in warranty period itself and was deposited to them as suggested by Nokia Care on 16th Feb 08, wide job sheet no .393434038/08216/24 Inderjeet (StarMobitel) told me after 3 months that they have misplaced my instrument and no replacemnet will be provided. My instrument was under warranty when I had submitted, I am running here and there but no resolution. Can someone guide me how to approach consumer court?
