Replacement of unrepairable Mobile Phone

Sir,

I had purchased a NOKIA Mobile Hand Set No. IMEI 357686017407987, Model No 3500c from M/s HOTSPOTS RETAILERS PVT. LTD. Ashok Vihar, on 17.01.2008. The Mobile Phone started giving trouble from the very day of its purchase. It suffered from call drops and cut outs and would frequently hung amidst conversation resulting in immense trouble and inflated bills. I immediately approached M/s HOTSPOTS RETAILERS PVT. LTD., on 17.01.2008 for its replacement but they refused to do so and asked too to go to the nearest NOKIA service center the M/s Venus Communication M/s NOKIA Care Centre, Ashok Vihar for replacement/repair. I, approached M/s Venus Communication, the NOKIA Care Centre, and appraised of the defect in the set and deposited the same for rectification of the defect/repair/replacement on 23.02.08 and so as to remove the problem. Fresh software was down loaded by the technician on the Care Centre and after doing the job of removing the defect the Mobile Phone was returned to me. But the Mobile phone again started giving aforesaid problem, consequently, I again visited the service centre appraised the fact of persisting the same defect and deposited the Mobile Phone again on 07.05.2008 and requested for the repair of the mobile Phone and be returned only after checking that the defect has been removed and there should not be chance of any defect again. After taking the delivery of the Mobile Phone by me, it again started giving problem of “call drop, hang up and cut outs” and I again deposited the Mobile Phone on 31.05. when they admitted that the defect had not been rectified and kept the same to be delivered 13.06.08 after repairing. I, in good faith, continued to make his best efforts to get the Mobile Phone repaired by the service Centre but the defect was not being rectified. I again contacted the referred Service Centre for replacement of the mobile phone and deposited it again on 17.6.08. However, incharge of the Service Centre realized and confessed this time that the set had got software problem and needs replacement and give them one last opportunity to get the same replaced from Party No. 1 and requested the complainant to collect the replaced Phone on 12.8.08. When I revisited the service centre, they informed me that replacement could not be made since it was unavailable. I was advised to take back the Phone for ten days with the assurance that since a replacement of the same could be made in 10 days when a new replacement with the same model number would be available. Accordingly I revisited the Party No.3 on 23.08.2008 for replacement of the Mobile Phone and deposited the same on 23.8.08. The delivery date given by the Service centre was 23.9.08 but no replacement was done on the given date. I have visited the Service centre several times but the replacement has not been done till date and all the assurances made turned untrue. The Mobile Phone is still lying with the said Service Centre.
