Sub: Illegal commercial activity being carried at the terrace of House No.70-H, Pocket A-2, Mayur Vihar Phase 3, DDA Flats, Delhi by Mr. Yogesh Sharma resident of House no. 69 F, Pocket A-2, Mayur Vihar Phase 3, DDA Flats, Delhi namely.
Sir,
This is to bring to your kind notice that Mr. Yogesh Sharma resident of House no. 69 F, Pocket A-2, Mayur Vihar Phase 3, DDA Flats, Delhi, is conducting illegal commercial activities on my terrace (i.e on the terrace of House no. 70 H, Pocket A-2, Mayur Vihar Phase 3, DDA Flats, Delhi) without any notice and without obtaining any permission from my side.
That Mr. Yogesh Sharma, has constructed a pigeon cage of 8 feets x 6 feets approx (photo attached) and is using the same for housing more than 50 pigeons. It is pertinent to mention that Mr. Yogesh Sharma is involved in the business of selling the pigeons for the purposes of meat. It is also important to note that some of the pigeons housed by Mr. Yogesh Sharma in his pigeon cage is of rare species and the applicant apprehends that the same may belong to preserved categories.
That Mr. Yogesh Sharma by his illegal business/activity is also creating following problems/nuisance:
i. That huge decaying material, fungus and other rotten garbage has accumulated in and around the pigeon cage and the same is creating foul smell.
ii. Due to the said deposit of decaying material it has also caused water logging on my terrace from where water has started seeping in causing damage to the entire residential structure
iii. That the decaying material is also attracting several diseases such as malaria, dengue etc which has been strictly prohibited by several government bodies of Delhi including civic organisations
iv. That conducting of commercial activity in a residential premises is also against law and is against the housing bye-laws of DDA,
v. That sell of pigeon meat has also compromised with the security of the entire DDA society as strangers and outsiders keep coming in order to purchase pigeon meat.
vi. That the applicant apprehends that Mr. Yogesh Sharma is involved in sell of meat of rare species of pigeons also, which is also a punishable offence.
That the applicant on several occasions and in the last public meeting held on 26.12.2010 requested Mr. Yogesh Sharma to stop the above said illegal activity in the best interest of the society at large. However, the efforts of the applicant went in vain and on the contrary Mr. Yogesh Sharma threatened the applicant.
You are therefore, most humbly requested to look into the matter and prevent Mr. Yogesh Sharma from conducting the above said illegal activity.
