COMPLAINT

The Hon'ble President,

Delhi State consumer Commission

Sub: Mental Torture. Harassment and Humiliation meted out to Senior Citizens defying the lofty claim of the Government on functioning of District Consumer Forum

Respected Sir (s)

It is implored upon your kind office to please take note of the following:-

1. That the petitioner is a senior law abiding citizen of about 80 years having serious ailments and ex-Indian Army Official is having a dwelling agricultural unit located in the abbadi of Chattarpur i.e. 4, Link Road, DLF, Chattarpur, New Delhi-110030.

2. That the petitioner is a consumer as defined in section 2 (1)(d) of the Consumer Protection Act, being the user of Electric Connection (meter) K NO. 011-445117-AP (Agriculture Purpose), installed at the abovesaid Farm House. It is pertinent to mention here that there were three other electric connections No. 711-149904-DL, 711-150027-DL and 711-150028-DL, in the names of son, wife and daughter of the petitioner respectively, on ‘AS IS WHERE IS BASIS’ for domestic use meant for servant quarters and residential use.

3. That the petitioner has been paying all the dues and demanded raised by the BSES and erstwhile *DESU’ and never defaulted on this score.

4. That the mental torture, agony and woes the petitioner started some time in March/April, when one of the officials of the Opposite party i.e. DESU and now BSES namely Sh. R.D. Sharma, J.E. wanted bribery of Rs. 10, 000/- per month for the continuing the electricity supply of the aforesaid K Nos. The petitioner being an honest and law abiding citizen rebuked Sh. Sharma for raising his demand for illegal gratification. On refusal Sh. R.D. Sharma became vindictive and revengeful towards the petitioner and made his mind to teach a lesson to the petitioner by way of Hook or by crook.

5. That all of a sudden on 18/04 without any notice and intimation the above official Sh. R.D. Sharma alongwith a Junior Engineer forcibly entered my premises and arbitrarily and illegally in a revengeful manner disconnected all the aforesaid connections installed there and took away the meters, cables. Having been informed by the petitioner’s servants of the atrocities and excesses committed by the officials, the petitioner begged them to wait but they deprived the petitioner of his right to live with dignitary and utter disregard to the petitioner’s age and profile. Furthermore, even the case of bribery was converted by BSES into a case of Direct Theft.

That on being approached by the petitioner to ascertain the reasons of the excesses, the petitioner was slapped with an exorbitant bill amounting to Rs.2, 22, 556/- and threatened that without depositing the bill on the next day i.e. 19/04, electricity connection will not be restored, in addition was intimidated for a criminal case.

7. That petitioner finding no alternative was forced to deposit the said inflated bill of Rs. 2, 22, 556/- under protest and pressure because of his plants and fruit being trees were withering/dying without water.

8. That the petitioner has been running from pillar to post to get back his hard earned money and security deposit and for restorations of his Agriculture Meter and other K Nos but in vain and personally approached all the connected higher officials including Chief Minister but in vain. It is worth mentioning here that the electricity company continued to raise the bill even thereafter which the petitioner continued to pay.

That because of total apathy, callous, indifferent and unwillingness attitude on the part of the BSES (DESU) forced me to file a consumer complaint which was registered vide No.1643 in the District Consumer Redressal Forum-II, Qutab Institutional, New Delhi titled as BALWANT SINGH V/S GM (Operations) BSES Rajdhani Power Limited which is still pending.

That case of the petitioner has not been decided by the District Consumer Forum till date, despite the fact that the petitioner never sought undue adjournment and every time by appearing in person pleaded before the Hon’ble Forum to decide the case seeing the age and long pending genuine case of the petitioner.

11. That none of the President/Members of the Consumer Forum have heeded to my request till date and further speak of the dereliction in exercise of their official-cum-judicial responsibilities.

12. That petitioner is not able to comprehend that why the Government has formed the District Forum for quick redressal, when it has taken almost 7 years to decide a small question of fact and pass the judgment.

13. Even the directions issued by National Consumer Redressal Commission vide Notification No. A-105/NCDRC dated 31/05 for attending to the complaints of Senior citizens and the patients having serious ailments ON PRIORITY have been defied.

PRAYER

In view o/ the above, the Hon’ble Court may be pleased to order in its gracious wisdom:-

(i) And pass necessary directions to decide the the petitioner case and general directions to the District Consumer Forums to decide the pending cases in a time bound framework having regard to Senior citizens and for patients having serious ailments.

(ii) To impose penalty in case of non-compliance by the erring District Forum.

(iii) To pass necessary legal deterrent action against the wrongdoers, and

(iv) To pass any other order (s)/directions as deemed fit in the facts and circumstances of the present petition.
