Subject: - Request for stopping the Unauthorized and Illegal Construction in total violation of the building bye-laws in the property bearing No. A-75, Third Floor, Dilshad Colony, Delhi – 110095

Sir,

The undersigned applicants beg to state as under –

1. That the applicants are the owners and in possession of the respective floors in the property No. A-75, Dilshad Colony, Delhi – 110095.

2. That the owners of the third floor of the property bearing No. A-75, Dilshad Colony, Delhi – 110095 are raising unauthorized and illegal construction over the roof of the third floor.

3. That the applicants have also gathered information that the going on construction activities over the roof of the third floor in the property No. A-75, Dilshad Colony, Delhi – 110095 is neither sanctioned nor duly authorized by the Municipal Corporation of Delhi as mandatorily required for the said purposes.

4. That the applicants are duty bound to inform your goodself regarding the starting of the construction work over the roof of the third floor.

5. That the applicants want to inform your goodself that Shri Prem R/s. S-2, Shri Anant Ram Sharma, R/o. S-1 and Shri Siddique R/o of S-3 of the property A-75, Dilshad Colony, Delhi – 110095 have already constructed illegal rooms set over the roof of the their respective flats without obtaining the sanctioned plan and authorization letter by your office.

6. That the applicants requested the owners of the third floor with folded hand to stop the illegal construction over the roof of the third floor as this space is for common use of all the occupants of the building and it is also effecting the structural stability of the building, but they are carrying the construction without fear of the law of the land.

7. That the owners of the third floor are very boasting of the high connection with the staff of M.C.D. and police and flaunting that no one can stop us to raise the construction without any sanction plan and they have been doing so in implicit consent of the staff of M.C.D. and police.

8. That the illegal and authorized construction will damage the base and structure of the building due to why our life are in danger as we are living with our family in the same building.

9. That going on illegal construction is effecting the building and our lives, so we are worried to see the going on illegal construction as the building is very old and base is very weak and it may collapse at any time.

10. That the anti-social people / occupants of the third floor of the building have no right to take the law into their hands and have no right to raise any illegal construction, which is totally illegal and which may repeat the big incident happened in LALITA PARK, Laxmi Nagar, Delhi.

11. That your goodself is duly bound to see that any unauthorized construction is not carried on over the roof of the third floor portion of the property bearing A-75, Dilshad Colony, Delhi – 110095.

It is therefore requested that your goodself be kind enough to take necessary legal action against the persons of third floor of the property bearing A-75, Dilshad Colony, Delhi - 110095 and be further pleased to stop/demolish the unauthorized construction over the roof of third floor, so that law of land may prevail.
