Sir,

i will like to inform that illigal construction started on 13-12 by Mr Balbeer Singh Sethi & his son Mr Amar Singh at above mention address, I immedeatly inform to police on 100 no to stop the said construction. Also submitted written complaint at Hari Nagar police station on 15dec to take necessary & concrete action on the submitted report but no action taken. Again given reminder on 17 jan by speed post recd by police station on 19 jan by regd no 99 but police has not taken any action ultimatly they have covered whole open space by febrication work & fibre sheet. I have also submitted copy of sale deed along with complaint .detail given here under,

1. That I am the attorney of Smt. Prem Kaur who is the owner of the entire 2nd Floor portion as well as the remaining portion, other than the 95 Sq. Yards, which was sold to Sardar Balbir Singh Sethi by Smt. Prem Kaur, of the 3rd Floor of the property bearing No. A-151, Fateh Nagar, New Delhi-110018

2. That Smt. Manjeet Kaur W/o the above said S. Balbir Singh Sethi, is now the owner of the apartment constructed on the west side portion of the third floor of House no. A-151, Fateh Nagar, New Delhi -110018 measuring 95 sq. yards, which includes open space measuring 15 sq. yards, by virtue of Sale Deed dated 25.09.2006 registered with the office of Sub Registrar SR II, Janakpuri New Delhi vide Registration No. 18685 in Book No. I, Vol. No. 14184 on pages 67 to 74 on dated 25.09.2006.

3. That the clauses 13 and 14 of the aforesaid sale deed dated 25.09.2006 lays down some of the terms and conditions of the sale of your apartment to you, which are as under:-

(a) That the occupants of the Ground Floor, First Floor and Second Floor can go on the roof of the top floor for repairing/setting of water tank & T.V. antenna only.

(b) That the third floor stair case door is common door to approach to third floor roof water tank (through ladder)

(c) That the key of the door will be kept in the custody of the vendor and vendee and the vendee will not used any other lock in the said door.

(d) That the said vendee i.e. Smt. Manjeet Kaur, shall not create any hindrance to go to the third floor for repairing/setting of water tank & T.V. antenna only.

(e) That in future the said vendee shall not construct civil/temporary/any additional construction on the roof of the second floor, and the roof of the third floor shall remain as open space & can be used as open terrace leaving the water tank area (four water tank measuring 8’x24’).

4. That as per the aforesaid sale deed dated 25.09.2006 Smt. Manjeet Kaur became the owner of the apartment constructed on the west side portion on the third floor measuring 95 sq yards and she or her husband or her son has no right title or interest in the vacant space on the third floor out side her portion measuring 95 sq yards. It is pertinent to mention here that the total area of the third floor on which her apartment is constructed, is 107 sq. yards and area of her apartment is 95n sq. yds as per the above said sale deed and thus the remaining about 12 sq. yds of the open space does not belong to her, but her husband, S. Balbir Singh Sethi along with her had amalgamated the said space with her apartment illegally & unauthorizedly, which has become a permanent cause of disturbance of peace among the residents of that house i.e. House No. A-151, Fateh Nagar, New Delhi -110018.

5. That as per the above said terms and conditions of sale of the aforesaid apartment Smt. Manjeet Kaur, the said owner of the third floor, was required to give a key of the lock used to lock the third floor stair case door and she is also restrained from constructing/adding either temporary or permanent structure either on the roof of the second floor or on the roof of the third floor, but firstly her husband, S. Balbir Singh Sethi, with her consent illegally & unauthorizedly had put lock, which can be opened only from inside i.e. from their side, on the door to the corridor to the staircase going to the roof of the third floor where the water tanks of the other floors’ residents are also located & also put door on the entry to the staircase, which is also kept locked by them. Thirdly they illegally & unauthorizedly had constructed temporary structures covering the open space with fiberglass sheets. It is pertinent to mention here that their aforesaid acts are not only totally in violation of the above mentioned terms and conditions of the aforesaid sale deed dated 25.09.2006 but also causing frequent quarrels among the residents of the said house thereby disturbing the peace of the area.

6. That they had also totally illegally, unauthorizedly created a stand by altering the original construction of stair case for putting an additional water tank creating not only hindrance in free movement of the residents on the other floor of the property bearing No. A-151 but also it may fall any time since while erecting this no standard guidelines with regard to erecting such structure has been followed. Further this is dangerous and if, it falls, it may lead to untoward incident to life and property of the residents.

7. That they had also totally illegally, unauthorizedly constructed a bed room and one store room by erecting walls and further also put a shed.

8. That they had also totally illegally, unauthorizedly got seepage in the roof of front portion of the Drawing room of my portion as a result of water logging due to washing of clothes/improper drainage of waste water from the roof of second floor i.e. on the floor of their portion. This seepage is continuously damaging the roof and also decreasing its strength day by day.

9. That they had been informed and requested number of times verbally by me regarding this unauthorized constructions, putting lock on the door, unauthorized occupation of the open space on the 3rd floor which belongs to me, putting of an additional water tank on temporary structure etc. as mentioned herein above to take appropriate action but they instead of rectifying their illegal & unauthorised actions start fighting with us resulting in disturbance of peace in the area.

10. That now the condition has worsened and I and my family members have started receiving threats from the said S. Balbir Singh Sethi & his said son, S. Amar Singh, that if in future we demand the removal of illegal structure raised by them or the keys to the third floor then be ready for the dire consequences.

In the circumstances as mentioned hereinabove I approach your goodself to take appropriate action against the said S. Balbir Singh Sethi & his son, S. Amar Singh so that I along with my family could live a peaceful life in my residence. I shall be highly thankful to you. Thanking you.

In Respect of the subject cited herein above I, Davinder Singh Gujral S/o Late S. Jaswant Singh resident of H. No. A-151, 2nd Floor, Fateh Nagar, New Delhi-110018, have to submit as under: -

on 2nd feb I requested to The President A Block Fateh Nagar R W A to visit to police station, we six members visited the sub-inspector on 2nd feb he assured to send all information to concerned deptt for demolition but even after 2months, no action is seen.

Now I am fawarding my complaint to your goodself to intervene in the matter for immideate action
