Dear Sir/Madam,
I am living at Basil Cottage, CBM Compound, Visakhapatnam and our group house has nine flats in total. There are 5 owners in total owning some part of the grouphouse each. One owner is in the US and does not participate in meetings. Now we are left with 4 owners. The issue is with the watchman trying to make a mockery out of his job. There was no election and one of the old owner assumed himself secretary of the apartment and passes on rules and regulations without consulting other flat owners (especially me). There are no meetings held, no circulars, no nothing an apartment should have.
The watchman argues with me on all issues and shouts at me despite that I am a flat owner and he is giving me no respect.
He says he is not responsible for anything lost in the aprtment and it is not his duty to gaurd the apartment from any intruders. He says his job is only to sweep the cellar, clean the cars and lift water to the head tank thats all. He goes out all the time getting some groceries or some stuff for the apartment owners. Now I am left with no security at all and other owners are forcing me to pay the maintainence fee which includes salary payment to the arrogant watchman. After consulting with the so called secretary, he says he will talk to the watchman and he cannot replace him.
Having said that there was another incident where my relatives tried to take control over my son when I was sick (kidney failure) and I was in ICU. I had given custody of my son temporarily to my neighbours since me and my wife are in hospital. Now this watchman has taken my relatives to my neightbours house and was asking them to hand over my son to my relatives. I feel this is attempt to kidnapping and after narrating this incident to the secretary he still says he want to keep the watchman. Now I feel that the watchman is a threat to my family and because only 2 owners oppose him, the self-assumed secretary is in denial of sacking the watchman. Now what should I do? Can I stop paying my part of the watchman salary (paying the other maintenence though)? They are using the watchman for the own needs and thus want to keep him. Taking this as an advantage, he is shouting at 2 flat owners including me and no one is doing anything to it.
Should I live frightened in my own house? They are ignoring me as a flat owner and I have undivided share in that apartment. Please help!
