Fraudulently Cancelling my Plot No. Plot no. G3-25 admeasuring 289 square yards in BPTP Parklands

Sir/Madam

We took a plot admeasuring 250 sq. yards @7, 450 Rs. per sq. yard from BPTP Ltd. Having there registered office at M-11 Middle Circle, Connaught Place, New Delhi – 110001, India & having their corporate office at BPTP Crest, Plot # 15, Udyog Vihar Phase-IV, Gurgaon -122 015, Haryana, India on 1/09 in a prelaunch state as they advertised for the same. The deal was done through signing advance registration form in the company’s format after which the company took cheques from us for Rs.3, 00, 0000&Rs.1, 00, 000 respectively which was duly honoured & receipt for the same is with us. Then the company after intervention from a Social Consumer Cell under which my whole family is also working as a part of our social responsibility for consumer interest under the name of “Consumer Federation of India” after which the company gave us an allotment letter for the plot after taking more than 50% payment of the total basic price as quoted above & allotted us Plot no. G3-25 admeasuring 289 square yards instead of 250 sq. Yards on 25th feb that is after 3 years of pre-launch that too after running from pillar to post & a lot of pressure & efforts of the consumer cell. Then since I, Mrs. Kamlesh Bansal, r/o A-22, Green Park Main, New Delhi-110026, the plot holder purchased the plot thinking that we, i.e., me & my husband who are in there senior citizen age will construct the plot into a house for our residence purpose so that we can get relief from the heavy rentals that we have to pay right now at our current residence, we keep on calling, writing & talking to the top management of the company to get physical possession of the plot so that we can make the payments for the leftover amount & take the possession but the company keep on giving us false baseless commitments of time till which they will hand over the physical possession of the plot. Then one fine day we happen to visit there site at Faridabad feeling that the company is not giving us satisfactory answers & know the exact status of the plot, there what we enquired & found we were taken aback the plot that the company has allotted us was not in existence there not even the block they were just digging going on that too after 5 years of launch then we came to know from the staff of the company there that the company did not even lay down any sewer & water lines & were also told that they don’t have clear permissions from many government departments so the process of giving physical possession to the plot holders are on hold till things are done& all formalities completed by the company & the government then it would be done with the company & the plot holders. Thus, we wrote a letter to the company asking for an explanation for the same, the company on the contrary through a phone call asked us to deposit our further instalment so that the company can further work on the completion of our plot. Honouring the telephonic demand made by the company we gave them further payments a cheque of Rs.2, 25, 384/- On the 24.01.2009 so that our work can be finished on a priority basis along with a letter again from Our Voluntary Consumer Cell to handover the physical possession on the immediate basis & take there residual amount. Then on 14th June the company send us a letter in which they pointed out a due of Rs.10, 87, 921/- as actual balance due out of a total amount of Rs.24, 69, 939/- & in addition to the above charges the company levied a Interest due (Calculated upto the date of letter, i.e., 14 June) amounting to Rs.4, 60, 842/- thus objecting to the interest they levied on us we objected the malpractices of the company through a legal letter to the company through Voluntary Consumer Cell “Consumer Federation Of India” .Recieving the letter company staff called us again after one month of receiving the letter& told us to pay the balance amount in order to get a complete waiver of the interest amount. Acting on the call we gave the company Rs.5, 00, 000/- on 29/07 for which the company send us a receipt on our official email ID updated in company records then again send them a cheque of Rs.2, 01, 058/- one month after that for which again the company send us the receipt then when we were preparing to give the cheque of the residual cheque of Rs.3, 86, 863/- which although as mentioned in the company’s letter was meant for laying of sewer and water lines/development of parks & laying down of Roads & none of this was implemented near the plot which the company has allotted to us till the date the last demand letter was drafted to us & send to us So we spoke in the company regarding the same to kindly do the needful as they have mentioned in there demand letter but the company on the contrary gave us a Notice of Termination of the plot on 2nd November along with a cheque of Rs.20, 18, 484/- deducting a amount of Rs.64, 592/- which they called it as brokerage. Acting on the letter we again spoke to various Top Management in the company so that our plot can be restored as we were dependent on the same as our future residential place shelling out all amount that we earned to get a self-owned house for residence in Faridabad in there project. We did not get any positive answer or solution from anyone in there Company moreover the Company’s M.D. Mr. Kabul Chawla even denied keeping a meeting to resolve the matter as we enquired in that area the plot rates were risen from Rs.7, 500/- Per sq. yard to Rs.25, 000/- per sq. yard as told to us by the brokers there as there was nothing available on the rates that the company has allotted the plot initially to us on their prelaunch state in 2005 on which we depended. Now the company top management, after intervention from a prominent lawyer who is even the counsel of the company & a common friend to us told us that they will restore the plot only in one condition if we are ready to pay a sum of Rs.10, 00, 000/- instead of actual balance of Rs.3, 86, 863/- more in total as they say the prices have gone up there particularly for this plot as the company’s developments are taking place co incidently around this plot now so M.D. of the company have a close eye on our plot & even threatened us that if not agreeable they will sell the plot to some other person for a price more than what they are asking. We tried to convince the company by telling them that we will go to the Honourable Consumer Court for the injustice they are doing with us as a consumer, on that person from there top management told us that they are not bothered about any litigation & we can do what we can as the M.D. the company has got powerful links with bureaucrats, judges& politicians so no one will do anything but the case will go on in the courts for 5-10years & said that we will till that time sell this plot to someone else for more rates so we would be left with nothing else but to take the amount what the company is offering that can be even if the Honourable Consumer Court hear the matter can be that the court will levy some harassment charges or some other charges which will never be equitable to the current value of the plot. Sir, we pray the honourable court to kindly take our matter to your kind perusal for judgement sir so that we can get our plot restored back to our name by this fraudulent company. Sir we even spoke to their legal team they very clearly told us that by litigating with this company we will do nothing but waste our time & money since company have several cases going in the court for the same reason that cn be handled easily by the prominent legal team for which the company pay them, they even informed that we will get nothing by litigating but dates & dates. Then after a long duration of litigation a small amount of compensation which the company is always ready to pay. Sir, then to enquire the same we went through the http://inconsumercomplaints.com site in which after merely writing the name of this company “BPTP” we got so many complaints of similar nature about this company that we learned that this company is habitual of doing such things & are fully prepared of the repercussions of the same. Sir but we being the honourable senior citizens of India working for the Consumer Interest from past 12 years as non-profit, non-political NGO, not supported financially from either Indian Government or elsewhere under a Organisation by the name of “Consumer Federation Of India”.Thus, sir we pray you to kindly help us in getting our residential plot restored back to our name so the we can pay back the actual dues of the company & get our plot back restored. Sir we look forward to hear from you at the earliest before its late & the company succeed in grabbing our plot as they have their evil eye on it due to increased prices & seek justice against this Fraudulent company.
