I have taken a flat on rent (L&L) in the above society.
We have been charged/fined Rs.500/- for dribbling football in the society premises for two minutes.
A resolution has been passed in its last AGM held on %%%%_ that playing of cricket, football and hockey are not allowed in the space available in the society premises. They circulated the minutes of the meeting to all the flat owners, but no Notice Board display was made about it.
On 27/28th January my son along with his a few friends was carrying the ball in his feet towards the society gate for a tournament held in the opposite building grounds. It was seen by the security man and he complained it to the society office.
Though, it was clearly understood that there was no game of football played and the children were only carrying the ball by their feet instead of in their hands; yet, the society office bearers have been adamant and have charged a fine. At least they could have given a warning let the matter subside.
Only when we went to the society office and narrated what exactly had happened on 27/28th January they have put a Notice Board information about charging fine. However, they have not refunded the money taken as fine to us yet.
Is the action taken by the society legitimate?
